AN ACT

 

1Amending Title 27 (Environmental Resources) of the Pennsylvania
2Consolidated Statutes, in disposal fee, further providing for
3disposal fee for municipal waste landfills, for deposit of
4disposal fee and for allocation for Environmental Stewardship
5Fund; and establishing the Intellectual Disabilities and
6Autism Waiting List Account.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Sections 6301(a), 6302 and 6305 of Title 27 of
10the Pennsylvania Consolidated Statutes are amended to read:

11§ 6301. Disposal fee for municipal waste landfills.

12(a) Imposition.--Except as otherwise provided in subsection
13(b), each operator of a municipal waste landfill shall pay, in
14the same manner prescribed in Chapter 7 of the act of July 28, 
151988 (P.L.556, No.101), known as the Municipal Waste Planning,
16Recycling and Waste Reduction Act, a disposal fee of [$4] $7 per
17ton for all solid waste disposed of at the municipal waste
18landfill. The fee established in this section shall apply to
19process residue and nonprocessible waste from a resource

1recovery facility that is disposed of at the municipal waste
2landfill and is in addition to the fee established in section
3701 of the Municipal Waste Planning, Recycling and Waste
4Reduction Act. The fee established by this subsection shall not
5be subject to the provisions of section 701(d) of the Municipal
6Waste Planning, Recycling and Waste Reduction Act.

8§ 6302. Deposit of disposal fee.

9Each fee collected under this chapter shall be deposited as
10follows:

11[(1) For the fiscal year 2002-2003, fees received by the
12department pursuant to section 6301 (relating to disposal fee
13for municipal waste landfills) shall be paid into the State
14Treasury as follows:

15(i) The first $50,000,000 in fees collected shall be
16deposited into the Environmental Stewardship Fund
17established in Chapter 61 (relating to environmental
18stewardship and watershed protection).

19(ii) Any fees collected thereafter shall be
20deposited in the General Fund.]

21(1) Three dollars of the fee shall be deposited into the
22Intellectual Disabilities and Autism Waiting List Account
23established in section 6307 (relating to Intellectual
24Disabilities and Autism Waiting List Account).

25(2) [For the fiscal year 2003-2004 and beyond, all fees 
26collected] Four dollars of the fee shall be deposited into
27the Environmental Stewardship Fund established in Chapter 61 
28(relating to environmental stewardship and watershed 
29protection).

30[§ 6305. Allocation for Environmental Stewardship Fund.

1For fiscal years 2002-2003 through 2006-2007, the department
2shall utilize 10% of the money allocated annually to it under
3section 6104(d) (relating to fund) to provide grants for safe
4drinking water projects and wastewater treatment projects.
5Grants under this section shall be made for the same purposes
6and shall be subject to the same limitations as grants
7authorized in section 6110 (relating to environmental
8infrastructure grants to water and wastewater treatment
9facilities).]

10Section 2. Title 27 is amended by adding a section to read:

11§ 6307. Intellectual Disabilities and Autism Waiting List
12Account.

13(a) Establishment.--The Intellectual Disabilities and Autism
14Waiting List Account is established as a restricted account
15within the General Fund.

16(b) Use of account.--

17(1) The moneys in the account are appropriated, upon 
18approval of the Governor, to the Department of Public Welfare 
19for the purpose of consumer-centered planning.

20(2) Any moneys remaining in the account after
21expenditure for the purpose specified in paragraph (1) may be
22used for one-time costs associated with the community
23intellectual disabilities and autism services system.

24(3) The moneys in the account may not be used to
25supplant resources for existing community resources.

26Section 3. This act shall take effect in 60 days.
