AN ACT
1 Establishing the Legislative Eisenhower Centennial Commission;
2 and providing for its funding.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Short title.
6 This act shall be known and may be cited as the Legislative
7 Eisenhower Centennial Commission Law.
8 Section 2. Legislative findings.
9 The General Assembly finds the following:
10 (1) October 14, 1990, will mark the 100th anniversary of
11 the birth of President Dwight David Eisenhower. To
12 commemorate the occasion, the Eisenhower Society DWIGHT D. <--
13 EISENHOWER SOCIETY, ORGANIZED IN 1969 AS A NONPROFIT
14 CORPORATION UNDER SECTION 301(C)(3) OF THE INTERNAL REVENUE
15 CODE OF 1986 (PUBLIC LAW 99-514, 26 U.S.C. § 301(C)(3)),
16 WHICH, WITH THE EISENHOWER EXCHANGE FELLOWSHIP, INCORPORATED,
17 OF PHILADELPHIA, ORGANIZED IN 1951, AS A NONPROFIT
1 CORPORATION UNDER SECTION 301(C)(3) OF THE INTERNAL REVENUE 2 CODE OF 1986, IS ONE OF TWO PERPETUAL LIVING MEMORIALS TO 3 DWIGHT DAVID EISENHOWER IN THIS COMMONWEALTH, and the 4 National Park Service will conduct a series of special events 5 at GETTYSBURG COLLEGE AND the Eisenhower National Historic <-- 6 Site in Gettysburg, AND ELSEWHERE IN Pennsylvania. <-- 7 (2) As an officer in the United States Army, President 8 Eisenhower first came to Gettysburg in the spring of 1918. At 9 Camp Colt, he was instrumental in founding a separate armored 10 unit known as the Tank Corps for which he won the 11 Distinguished Service Medal. 12 (3) Following his service as Supreme Commander of Allied 13 Forces in Europe during World War II and its aftermath, 14 President Eisenhower purchased a farm near the battlefield at 15 Gettysburg as a country retreat in 1950 1951. The farm was <-- 16 the first home that he THE GENERAL and his wife, Mamie DOWD <-- 17 EISENHOWER, ever owned and was the only truly permanent home 18 the Eisenhowers were to have. 19 (4) The Eisenhower Farm also was the site of important 20 official visits by many heads of state, including Soviet 21 Premier Nikita Khruschev, British Prime Minister Sir Winston 22 Churchill and French President Charles de Gaulle. 23 (5) IN 1961, UPON LEAVING THE WHITE HOUSE, THE <-- 24 EISENHOWERS CHOSE THIS COMMONWEALTH AS THEIR STATE RESIDENCE, 25 AND LIVED AT THE GETTYSBURG FARM UNTIL THE GENERAL'S DEATH IN 26 1969 AND UNTIL MAMIE EISENHOWER'S DEATH IN 1979. 27 (5) (6) Because the Eisenhower Farm in Gettysburg played <-- 28 such an important role both in the personal and public life 29 of President Eisenhower and in the history of the United 30 States, it is wholly appropriate for the General Assembly to 19880H2506B3940 - 2 -
1 encourage the active participation of the Commonwealth in the 2 celebration of the 100th anniversary of the birth of our 34th 3 president. 4 Section 3. Definitions. 5 The following words and phrases when used in this act shall 6 have the meanings given to them in this section unless the 7 context clearly indicates otherwise: 8 "Commission." The Legislative Eisenhower Centennial 9 Commission. 10 "National Park Service." The National Park Service of the 11 Department of the Interior of the Federal Government. 12 Section 4. Commission created. 13 The General Assembly hereby creates the Legislative 14 Eisenhower Centennial Commission to encourage and, PLAN, DEVELOP <-- 15 AND COORDINATE OBSERVANCES AND ACTIVITIES, AND TO enhance the 16 participation of the Commonwealth in the observance of the 100th 17 anniversary of the birth of President Dwight David Eisenhower. 18 Section 5. Membership. 19 The commission shall be comprised of four members of the <-- 20 General Assembly and four members of the public. One legislative 21 and one public member shall be appointed by each of the 22 following: the Speaker of the House of Representatives, the 23 Minority Leader of the House of Representatives, the President 24 pro tempore of the Senate and the Minority Leader of the Senate. 25 EIGHT MEMBERS OF THE GENERAL ASSEMBLY, FOUR FROM THE HOUSE OF <-- 26 REPRESENTATIVES AND FOUR FROM THE SENATE; FOUR MEMBERS OF THE 27 PUBLIC; THE COFOUNDER OF THE DWIGHT D. EISENHOWER SOCIETY, THE 28 PRESIDENT OF GETTYSBURG COLLEGE AND THE SUPERINTENDENT OF THE 29 GETTYSBURG NATIONAL MILITARY PARK ON BEHALF OF THE EISENHOWER 30 NATIONAL HISTORIC SITE; AND THE PRESENT MEMBERS OF THE HOUSE OF 19880H2506B3940 - 3 -
1 REPRESENTATIVES AND THE SENATE WHOSE DISTRICTS ENCOMPASS 2 GETTYSBURG. THE SPEAKER OF THE HOUSE OF REPRESENTATIVES AND THE 3 MINORITY LEADER OF THE HOUSE OF REPRESENTATIVES SHALL EACH 4 APPOINT TWO MEMBERS OF THE HOUSE OF REPRESENTATIVES AND ONE 5 PUBLIC MEMBER. THE PRESIDENT PRO TEMPORE AND THE MINORITY LEADER 6 OF THE SENATE SHALL EACH APPOINT TWO MEMBERS OF THE SENATE AND 7 ONE PUBLIC MEMBER. The commission shall elect a chairman from 8 among its members. 9 Section 6. Powers and duties. 10 The commission shall: 11 (1) Cooperate with the Eisenhower Society, DWIGHT D. <-- 12 EISENHOWER SOCIETY, GETTYSBURG COLLEGE AND the National Park 13 Service and any other public or private groups ENTITIES <-- 14 planning for the observance of the Eisenhower Centennial in 15 this Commonwealth, AS CONSIDERED APPROPRIATE BY THE <-- 16 COMMISSION, UPON APPLICATION THERETO. 17 (2) Be empowered to enter into contracts and execute all 18 instruments necessary or convenient for carrying out its 19 operations. 20 (3) Authorize expenditures NOT EXCEEDING $500,000 from <-- 21 any funds appropriated or provided to support the activities 22 of the Eisenhower Centennial in this Commonwealth, WITH <-- 23 $100,000 THEREOF INCLUDING FUNDING BEING AUTHORIZED TOWARD <-- 24 THE CASTING OF A BRONZE STATUE OF THE GENERAL FOR EMPLACEMENT 25 IN LINCOLN SQUARE OF GETTYSBURG. 26 (4) Submit a report to the General Assembly of the 27 activities of the commission. 28 Section 7. Contributions. 29 In addition to any funds appropriated by the General Assembly 30 to support the activities of the commission, all moneys received 19880H2506B3940 - 4 -
1 from other sources as contributions to these activities shall be 2 paid into the General Fund and credited to this appropriation. 3 The commission shall also be authorized to accept services and 4 in-kind contributions for its activities. 5 Section 8. Sunset. 6 (a) Final report.--The commission shall complete its 7 business and submit its final report to the General Assembly by 8 November 30, 1990. 9 (b) Expiration.--This act shall expire and the commission 10 shall terminate November 30, 1990. 11 Section 9.
