AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, defining "State-owned vehicle"; and providing for

3

accidents involving State-owned vehicles.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 102 of Title 75 of the Pennsylvania

7

Consolidated Statutes is amended by adding a definition to read:

8

§ 102.  Definitions.

9

Subject to additional definitions contained in subsequent

10

provisions of this title which are applicable to specific

11

provisions of this title, the following words and phrases when

12

used in this title shall have, unless the context clearly

13

indicates otherwise, the meanings given to them in this section:

"State-owned vehicle."  A vehicle that is owned by the

16

Commonwealth, not including vehicles that are used for law

17

enforcement purposes.

Section 2.  Title 75 is amended by adding a section to read:

§ 3758.  Accidents involving State-owned vehicles.

(a)  General rule.--All traffic accidents involving a State-

5

owned vehicle shall be reported by the operator of that vehicle

6

as soon as possible to the municipal law enforcement department

7

in the jurisdiction where the accident occurred or to the

8

Pennsylvania State Police if no local law enforcement department

9

exists in that municipality. The accident shall be investigated

10

by either the municipal law enforcement department or by the

11

Pennsylvania State Police and a copy of the vehicle accident

12

report shall be filed with the Department of General Services.

(b)  Penalties.--Failure to comply with subsection (a) by the

14

operator of any State-owned vehicle involved in an accident

15

shall for a first offense result in a six-month prohibition from

16

operating a State-owned vehicle. Upon a second offense, the

17

violator shall be permanently ineligible to operate a State-

18

owned vehicle.

Section 2.  This act shall take effect in 60 days.
