AN ACT 1 Establishing the Community and Economic Development Advisory 2 Committee. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Short title. 6 This act shall be known and may be cited as the Community and 7 Economic Development Advisory Committee Act. 8 Section 2. Legislative intent. 9 It is the intent of this act to keep the Governor and the 10 General Assembly informed as to needs and priorities of 11 community and economic development services within this 12 Commonwealth. This will be achieved through the creation of a 13 State Community and Economic Development Advisory Committee 14 which shall review existing statutes, programs, funding and 15 activities by State and local agencies which affect economic 16 development within this Commonwealth.
1 Section 3. Definitions. 2 The following words and phrases when used in this act shall 3 have the meanings given to them in this section unless the 4 context clearly indicates otherwise: 5 "Department." The Department of Community and Economic 6 Development of the Commonwealth. 7 "Secretary." The Secretary of Community and Economic 8 Development of the Commonwealth. 9 "State agency." The Governor, departments, boards, 10 commissions, authorities and other agencies and officers of the 11 Commonwealth government, including those subject to the policy 12 supervision and control of the Governor. The term does not 13 include any court or other officer or agency of the unified 14 judicial system or the General Assembly and its officers and 15 agencies. 16 Section 4. Community and Economic Development Advisory 17 Committee. 18 (a) Establishment.--The department shall establish the 19 Community and Economic Development Advisory Committee 20 hereinafter referred to as CEDAC. 21 (b) Purpose and responsibilities.-- 22 (1) The Community and Economic Development Advisory 23 Committee shall review Statewide community and economic 24 development service needs and priorities and shall advise the 25 department on coordination of Federal, State and local 26 resources and how Statewide needs and priorities should be 27 addressed by the department's annual financing strategy. 28 (2) The membership shall be geographically dispersed in 29 order to include urban, suburban and rural areas. Every 30 effort shall also be made to ensure a diversity of race, 19980H2533B3446 - 2 -
1 ethnic origin, household composition, age, religion, sex and 2 disability status. 3 (3) Meetings shall be advertised and conducted pursuant 4 to the act of July 3, 1986 (P.L.388, No.84), known as the 5 Sunshine Act. 6 (4) The department shall present a report annually to 7 the legislature which will detail the findings and decisions 8 of the CEDAC for the previous year. 9 (c) Composition.-- 10 (1) The CEDAC will be chaired by the secretary and will 11 meet at least semiannually. The Governor will appoint CEDAC 12 members to serve two-year terms, except members of the 13 General Assembly and the representatives elected by each 14 regional community and economic development advisory 15 committee. Support staff for the CEDAC will be provided by 16 the department. 17 (2) No member will receive compensation or remuneration 18 for participation on the CEDAC. 19 (3) The CEDAC shall consist of at least 25 but no more 20 than 35 residents of this Commonwealth and shall include, at 21 a minimum, the following: 22 (i) The secretary or a designee thereof. 23 (ii) The Secretary of Labor and Industry or a 24 designee thereof. 25 (iii) The Secretary of Public Welfare or a designee 26 thereof. 27 (iv) Two members of the Senate, one appointed by the 28 President pro tempore and the other by the Minority 29 Leader. 30 (v) Two members of the House of Representatives, one 19980H2533B3446 - 3 -
1 appointed by the Speaker of the House of Representatives 2 and the other by the Minority Leader. 3 (vi) The Executive Director of the Pennsylvania 4 Chamber of Business and Industry or a designee thereof. 5 (vii) The Executive Director of the Pennsylvania 6 Economic Development Agency (PEDA) or a designee thereof. 7 (viii) The Executive Director of the Urban 8 Redevelopment Authority of Philadelphia or a designee 9 thereof. 10 (ix) The Executive Director of the Urban 11 Redevelopment Authority of Pittsburgh or a designee 12 thereof. 13 (x) A representative from the Ben Franklin 14 Technology Centers. 15 (xi) The Executive Director of the Pennsylvania 16 Small Business Development Center or a designee thereof. 17 (xii) A representative from The Pennsylvania 18 Industrial Development Authority (PIDC) or a designee 19 thereof. 20 (xiii) A representative from The Pennsylvania 21 Housing and Redevelopment Authority or a designee 22 thereof. 23 (xiv) The Executive Director of the African-American 24 Chamber of Commerce or a designee thereof. 25 (xv) A representative of the Industrial Development 26 Authorities and Corporations within this Commonwealth. 27 (xvi) A representative of the Industrial Resource 28 Centers within this Commonwealth. 29 (xvii) A representative of the banking industry. 30 (xviii) A representative of the county tourism 19980H2533B3446 - 4 -
1 promotion agencies. 2 (xix) The Executive Director of the Pennsylvania 3 Economic Development Financing Authority or a designee 4 thereof. 5 (d) Subcommittees and ad hoc committees.--The CEDAC may, as 6 it deems necessary, establish subcommittees and ad hoc 7 committees, comprised of non-CEDAC members, to assess special 8 needs and obtain public input. These subcommittees and ad hoc 9 committees will report to CEDAC. 10 Section 5. Powers and duties. 11 The CEDAC shall have the responsibility and authority: 12 (1) To advise the Governor and the General Assembly in 13 regards to community and economic development policies 14 Statewide. 15 (2) To review existing economic development statutes and 16 recommend changes. 17 (3) To review existing economic development programs and 18 recommend changes. 19 (4) To review any activities of other State agencies 20 that affect economic development within this Commonwealth. 21 (5) To review any educational and job training funding 22 that supports industrial growth. 23 Section 6. Severability. 24 The provisions of this act are severable. If any provision of 25 this act or its application to any person or circumstance is 26 held invalid, the invalidity shall not affect other provisions 27 or applications of this act which can be given effect without 28 the invalid provision or application. 29 Section 7.
