                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Pennsylvania Historical and Museum
     3     Commission and the Governor, to grant and convey to Luzerne
     4     County Historical Society, certain lands and building situate
     5     in the Borough of Forty Fort, County of Luzerne, Commonwealth
     6     of Pennsylvania; AND AUTHORIZING THE DEPARTMENT OF GENERAL     <--
     7     SERVICES, WITH THE APPROVAL OF THE GOVERNOR, TO GRANT AND
     8     CONVEY, THROUGH COMPETITIVE BIDDING OR PUBLIC AUCTION,
     9     CERTAIN TRACTS OF LAND TOGETHER WITH ANY IMPROVEMENTS THEREON
    10     SITUATE IN THE TWELFTH WARD OF THE CITY OF ALLENTOWN AND IN
    11     SALISBURY TOWNSHIP, LEHIGH COUNTY; AUTHORIZING AND DIRECTING   <--
    12     THE DEPARTMENT OF GENERAL SERVICES, WITH THE APPROVAL OF THE
    13     PENNSYLVANIA HISTORICAL AND MUSEUM COMMISSION AND THE
    14     GOVERNOR, TO EXECUTE A CORRECTIVE DEED TO REVISE A DEED
    15     RESTRICTION ON CERTAIN REAL ESTATE CONVEYED TO THE
    16     NORTHUMBERLAND COUNTY HISTORICAL SOCIETY, SITUATE IN THE
    17     TOWNSHIP OF UPPER AUGUSTA, COUNTY OF NORTHUMBERLAND; AND
    18     MAKING A REPEAL.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21  Section 1.  Authorization.                                        <--
    22     The Department of General Services, with the approval of the
    23  SECTION 1.  CONVEYANCE IN FORTY FORT, LUZERNE COUNTY.             <--
    24     (A)  AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH
    25  THE APPROVAL OF THE Pennsylvania Historical and Museum

     1  Commission and the Governor, is hereby authorized and directed
     2  on behalf of the Commonwealth of Pennsylvania to grant and
     3  convey to Luzerne County Historical Society, for One Dollar,
     4  ($1.00), a tract of land and a building known as the "Dennison
     5  House" as described in section 2 SUBSECTION (B).                  <--
     6  Section 2.  Description.                                          <--
     7     (B)  DESCRIPTION.--ALL THAT CERTAIN piece or parcel of land,   <--
     8  situate in the Borough of Forty-Fort bounded and described as
     9  follows:
    10     BEGINNING AT a corner being the intersection of the Westerly
    11  line of Wyoming Avenue and the Northerly line of Dennison
    12  Street, thence North thirty-nine degrees twenty-two minutes East
    13  along said Wyoming Avenue one-hundred five and ninety-seven one-
    14  hundredths (105.97) feet to a corner, thence North seventy-four
    15  degrees one minute East still along Wyoming Avenue forty-six and
    16  eighty-six one-hundredths (46.86) feet, more or less to a corner
    17  dividing Lots No's 1 and 2 on plot of lots known as Englewood
    18  Terrace, recorded in Luzerne County Map Book No. 2, page 294;
    19     THENCE North twelve degrees fifty-six minutes West along said
    20  Lot No. 2 two-hundred ninety-eight and twenty-nine one-
    21  hundredths (298.29) feet to a corner;
    22     THENCE North twenty-seven degrees West still along line of
    23  lot No. 2, eighty-five (85) feet to a corner on Englewood
    24  Avenue.
    25     THENCE South forty-seven degrees twenty-seven minutes West
    26  eighty-nine (89) feet to a corner in line of Dennison Street;
    27     THENCE South twenty-eight degrees forty-four minutes East
    28  along the Northerly line of Dennison Street thirty-nine and
    29  thirteen one-hundredths (39.13) feet;
    30     THENCE South six degrees twelve minutes East still along line

     1  of Dennison Street, three hundred sixty-eight and eighty-eight
     2  one-hundredths (368.88) feet to Wyoming Avenue, the place of
     3  beginning.
     4     BEING Lot No. 1 on said plot of lots and improved with a
     5  three story single frame dwelling known as 35 Dennison Street,
     6  Forty Fort, Luzerne County, Pennsylvania
     7     Together with and subject to all easements, rights,
     8  covenants, appurtenances, exceptions, reservations, restrictions
     9  and conditions contained in prior instruments in the chain of
    10  title.
    11     BEING the same premises conveyed by Hugh H. McClelland, Jr.
    12  and Nancy W. McClelland his wife to David M. Ogden and Elizabeth
    13  V.N. Ogden, his wife by deed dated March 5, 1963, recorded in
    14  Luzerne County Deed Book No. 1516, page 939.
    15  Section 3.  Easements.                                            <--
    16     The conveyance shall be made under and subject to all lawful
    17     (C)  EASEMENTS.--THE CONVEYANCE SHALL BE MADE UNDER AND        <--
    18  SUBJECT TO ALL LAWFUL and enforceable easements, servitudes and
    19  rights of others, including, but not confined to, streets,
    20  roadways and rights of any telephone, telegraph, water,
    21  electric, gas or pipeline companies, as well as under and
    22  subject to any lawful and enforceable estates or tenancies
    23  vested in third persons appearing of record, for any portion of
    24  the land or improvements erected thereon.
    25  Section 4.  Execution.                                            <--
    26     The deed of conveyance shall be by Special Warranty Deed and
    27     (D)  EXECUTION.--THE DEED OF CONVEYANCE SHALL BE BY SPECIAL    <--
    28  WARRANTY DEED AND shall be executed by the Secretary of General
    29  Services in the name of the Commonwealth of Pennsylvania.
    30  Section 5.  Reversion.                                            <--

     1     The deed of conveyance shall contain a clause that the
     2     (E)  REVERSION.--THE DEED OF CONVEYANCE SHALL CONTAIN A        <--
     3  CLAUSE THAT THE property conveyed herein shall be used for
     4  educational or historical exhibition/public purposes only.
     5  Should the Grantee allow the property conveyed to be used for
     6  any other purpose or attempts to convey the Premises, title
     7  shall immediately revert to and revest in the Grantor. However,
     8  the Grantor and Grantee, or their successors and assigns, agree
     9  that should the within named Grantee, or its successors,
    10  dissolve or cease to remain in existence, then the Grantee, or
    11  its successors, may allow title to the above-described real
    12  estate to be conveyed to a successor organization that has the
    13  same objectives, purposes and goals as the Grantee, said
    14  conveyance to be subject to the other covenants and restrictions
    15  set forth in this deed.
    16  Section 6.  Restrictions.                                         <--
    17     The deed of conveyance shall contain a clause that requires
    18     (F) RESTRICTIONS.--THE DEED OF CONVEYANCE SHALL CONTAIN A      <--
    19  CLAUSE THAT REQUIRES the Grantee to maintain and preserve the
    20  Premises by ensuring that any improvements to the property are
    21  compatible with its original architectural design and
    22  landscape/site plan in terms of scale, massing, fenestration,
    23  materials and color, and is consistent with the recommended
    24  approaches in the Secretary of the Interior's Standards for
    25  Rehabilitation and Guidelines for Rehabilitating Historic
    26  Buildings, as revised in 1995. Further, no new construction,
    27  demolition, alteration, remodeling or landscaping/site work
    28  shall be undertaken or permitted to be undertaken on the
    29  property without the prior written approval of the Pennsylvania
    30  Historical and Museum Commission.

     1  Section 7.  Costs and fees.                                       <--
     2     Costs and fees incidental to this conveyance shall be borne
     3     (G)  COSTS AND FEES.--COSTS AND FEES INCIDENTIAL TO THIS       <--
     4  CONVEYANCE SHALL BE BORNE by the Grantee.
     5  SECTION 2.  CONVEYANCE IN ALLENTOWN AND SALISBURY TOWNSHIP,       <--
     6                 LEHIGH COUNTY.
     7     (A)  AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH
     8  THE APPROVAL OF THE GOVERNOR, IS HEREBY AUTHORIZED ON BEHALF OF
     9  THE COMMONWEALTH OF PENNSYLVANIA TO GRANT AND CONVEY, AT A PRICE
    10  TO BE DETERMINED THROUGH COMPETITIVE BIDDING OR PUBLIC AUCTION,
    11  CERTAIN LAND TOGETHER WITH ANY IMPROVEMENTS THEREON DESCRIBED IN
    12  SUBSECTION (B). THE TRACTS MAY BE OFFERED FOR SALE TOGETHER OR
    13  SEPARATELY.
    14     (B)  DESCRIPTION.--THE PROPERTY TO BE CONVEYED PURSUANT TO
    15  THIS SECTION CONSISTS OF TWO TRACTS OF LAND BOUNDED AND
    16  DESCRIBED AS FOLLOWS:

    22     (C)  EASEMENTS.--THE CONVEYANCES SHALL BE MADE UNDER AND

    24  RIGHTS OF OTHERS, INCLUDING BUT NOT CONFINED TO STREETS,

     2  SERVICES IN THE NAME OF THE COMMONWEALTH OF PENNSYLVANIA.
     3     (E)  PROCEEDS.--THE PROCEEDS FROM THE SALE OF LANDS UNDER
     4  THIS SECTION SHALL BE DEPOSITED INTO THE CAPITAL FACILITIES
     5  FUND. THE FUNDS SHALL BE UTILIZED BY THE DEPARTMENT OF GENERAL
     6  SERVICES TO ACQUIRE AND RENOVATE, OR CONSTRUCT REPLACEMENT
     7  FACILITIES FOR THE DEPARTMENT OF TRANSPORTATION'S ENGINEERING
     8  DISTRICT 5-0. ANY FUNDS REMAINING FOLLOWING THE ACQUISITION AND
     9  RENOVATION, OR CONSTRUCTION OF REPLACEMENT FACILITIES SHALL BE
    10  TRANSFERRED TO THE GENERAL FUND.
    11  SECTION 3.  CORRECTIVE DEED FOR PROPERTY SITUATE IN UPPER         <--

    13     (A)  AUTHORIZATION TO EXECUTE DEED.--THE DEPARTMENT OF

    15  HISTORICAL AND MUSEUM COMMISSION, AND THE GOVERNOR, IS HEREBY
    16  AUTHORIZED AND DIRECTED ON BEHALF OF THE COMMONWEALTH OF
    17  PENNSYLVANIA TO EXECUTE A CORRECTIVE DEED TO REVISE A USE
    18  RESTRICTION AND REVERSIONARY COVENANT PLACED ON THE LANDS

     4  COUNTY, PENNSYLVANIA; AUTHORIZING AND DIRECTING THE DEPARTMENT
     5  OF GENERAL SERVICES, WITH THE APPROVAL OF THE GOVERNOR, TO
     6  CONVEY TO HARTLEY TOWNSHIP A TRACT OF LAND SITUATE IN HARTLEY
     7  TOWNSHIP, UNION COUNTY, PENNSYLVANIA; AND MAKING REPEALS."
     8     (B)  REVISED USE RESTRICTION AND REVERSIONARY COVENANT.--
     9         (1)  THE REVISED USE RESTRICTION AND REVERSIONARY
    10     COVENANT SHALL READ AS FOLLOWS:
    11     UNDER AND SUBJECT TO THE CONDITION THAT THE LAND CONVEYED
    12  UNDER SECTION 5(A) OF THE ACT OF DECEMBER 18, 1992 (P.L.1670,
    13  NO.185), FOUND IN A DEED DATED AND RECORDED IN THE
    14  NORTHUMBERLAND COUNTY RECORDER OF DEEDS OFFICE IN DEED BOOK VOL.
    15  1104, PAGE 157, SHALL BE USED FOR PUBLIC AND EDUCATIONAL
    16  PURPOSES AND IF AT ANY TIME THE GRANTEE OR ITS SUCCESSORS IN
    17  FUNCTION CONVEYS SAID PROPERTY TO ANY ENTITY OTHER THAN THE
    18  SHIKELLAMY SCHOOL DISTRICT, OR ITS SUCCESSORS IN FUNCTION, OR
    19  AUTHORIZES OR PERMITS SAID PROPERTY TO BE USED FOR ANY PURPOSE
    20  OTHER THAN THOSE AFOREMENTIONED, THE TITLE TO THE LAND HEREIN
    21  CONVEYED SHALL IMMEDIATELY REVERT TO AND REVEST IN THE
    22  COMMONWEALTH OF PENNSYLVANIA.
    23     ALSO UNDER AND SUBJECT TO THE CONDITION THAT THE GRANTEE MUST
    24  HAVE THE PROPOSED PROPERTY USE REVIEWED AND APPROVED IN WRITING
    25  BY THE STATE PRESERVATION OFFICER OF THE PENNSYLVANIA HISTORICAL
    26  AND MUSEUM COMMISSION PRIOR TO COMMENCING ANY LAND USE CHANGE OR
    27  CONSTRUCTION.
    28         (2)  ANY CONVEYANCE OF THE LANDS DESCRIBED IN SECTION
    29     5(A) OF THE ACT OF DECEMBER 18, 1992 (P.L.1670, NO.185),
    30     FOUND IN A DEED DATED AND RECORDED IN THE NORTHUMBERLAND

     1     COUNTY RECORDER OF DEEDS OFFICE IN DEED BOOK VOL. 1104, PAGE
     2     157, BY THE NORTHUMBERLAND COUNTY HISTORICAL SOCIETY TO THE
     3     SHIKELLAMY SCHOOL DISTRICT, OR ITS SUCCESSORS IN FUNCTION,
     4     SHALL CONTAIN THE AMENDED USE AND REVERSIONARY COVENANT AS
     5     DESCRIBED IN PARAGRAPH (1).
     6     (C)  OTHER PROVISIONS.--THE CORRECTIVE DEED SHALL BE MADE
     7  UNDER AND SUBJECT TO ALL LAWFUL AND ENFORCEABLE EASEMENTS,
     8  SERVITUDES AND RIGHTS OF OTHERS, INCLUDING BUT NOT CONFINED TO
     9  STREETS, ROADWAYS AND RIGHTS OF ANY TELEPHONE, TELEGRAPH, WATER,
    10  ELECTRIC, GAS OR PIPELINE COMPANIES, AS WELL AS UNDER AND
    11  SUBJECT TO ANY LAWFUL AND ENFORCEABLE ESTATES OR TENANCIES
    12  VESTED IN THIRD PERSONS APPEARING OF RECORD, FOR ANY PORTION OF
    13  THE LAND OR IMPROVEMENTS ERECTED THEREON.
    14     (D)  EXECUTION.--THE CORRECTIVE DEED SHALL BE EXECUTED BY THE
