                                     AN ACT

     1  Regulating the provision of caller identification service; and
     2     providing for duties of the Pennsylvania Public Utility
     3     Commission.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Caller
     8  Identification Service Act.
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Commission."  The Pennsylvania Public Utility Commission.
    14     "Telecommunications carrier."  An entity that provides
    15  telecommunications services subject to the jurisdiction of the
    16  Pennsylvania Public Utility Commission.
    17     "Telecommunications service."  The offering of the


     1  transmission of messages or communications for a fee to the
     2  public.
     3  Section 3.  Caller identification service.
     4     (a)  General rule.--A telecommunications carrier that offers
     5  a caller identification service that identifies the name and
     6  telephone number of a caller for an additional fee may not
     7  charge a residential customer within this Commonwealth more than
     8  $3.50 per month for basic caller identification service that
     9  identifies the name and the telephone number of a caller unless:
    10         (1)  the telecommunications carrier requests a waiver
    11     from the monthly dollar limitation set forth in this
    12     subsection; and
    13         (2)  the commission determines that the monthly dollar
    14     limitation set forth in this subsection is not just and
    15     reasonable in relation to the actual cost to the
    16     telecommunications carrier for the service.
    17     (b)  Nonapplicability.--Subsection (a) shall not apply to the
    18  bundling or pricing of multiple services that include caller
    19  identification service in a single offer.
    20  Section 4.  Effective date.
    21     This act shall take effect in 60 days.
