                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for termination of
     3     utility service.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1406(b) of Title 66 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1406.  Termination of utility service.
     9     * * *
    10     (b)  Notice of termination of service.--
    11         (1)  Prior to terminating service under subsection (a), a
    12     public utility:
    13             (i)  Shall provide written notice of the termination
    14         to the customer at least ten days prior to the date of
    15         the proposed termination. The termination notice shall


     1         remain effective for 60 days. The termination notice
     2         shall include contact information, eligibility guidelines
     3         and a brief explanation of available customer assistance
     4         options, including, but not limited to, LIHEAP, customer
     5         assistance programs and weatherization programs.
     6             (ii)  Shall attempt to contact the customer or
     7         occupant, either in person or by telephone, to provide
     8         notice of the proposed termination at least three days
     9         prior to the scheduled termination. Phone contact shall
    10         be deemed complete upon attempted calls on two separate
    11         days to the residence between the hours of 7 a.m. and 9
    12         p.m. if the calls were made at various times each day.
    13             (iii)  During the months of December through March,
    14         unless personal contact has been made with the customer
    15         or responsible adult by personally visiting the
    16         customer's residence, the public utility shall, within 48
    17         hours of the scheduled date of termination, post a notice
    18         of the proposed termination at the service location.
    19             (iv)  After complying with paragraphs (ii) and (iii),
    20         the public utility shall attempt to make personal contact
    21         with the customer or responsible adult at the time
    22         service is terminated. Termination of service shall not
    23         be delayed for failure to make personal contact.
    24         (2)  The public utility shall not be required by the
    25     commission to take any additional actions prior to
    26     termination.
