AN ACT

Providing for the Pennsylvania Blue Alert System; authorizing

2

and directing the Pennsylvania State Police to establish and

3

maintain the Pennsylvania Blue Alert System; assessing costs;

4

and providing for immunity and penalties.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Pennsylvania Blue Alert System established.

8

The Pennsylvania State Police shall establish and maintain

9

the Pennsylvania Blue Alert System to assist in the apprehension

10

of those suspected of killing or seriously injuring Federal,

11

State or local law enforcement officers through prompt

12

notification to the general public and appropriate law

13

enforcement authorities. The Pennsylvania State Police shall

14

establish such protocols and procedures as are necessary for the

15

effective operation of this system and shall educate and inform

16

local law enforcement agencies and the public with regard to its

availability. At a minimum the following criteria must be met to

2

activate the system:

(1)  A law enforcement officer must have been killed or

4

seriously injured by an offender.

5

(2)  The investigating law enforcement agency must

6

determine that the suspect poses a serious risk or threat to

7

the public or other law enforcement personnel.

8

(3)  A detailed description of the make and model of the

9

suspect's vehicle or a complete or partial registration plate

10

number of the suspect's vehicle must be available for

11

broadcast to the public.

12

(4)  The investigating law enforcement agency having

13

jurisdiction must recommend activation of the system.

14

Section 2.  Prohibited use.

15

The transmission, broadcast or other communication of a

16

public alert, other than through the Pennsylvania Blue Alert

17

System, intentionally, knowingly, recklessly or negligently

18

purporting to be made by, with or through the authority of the

19

Pennsylvania Blue Alert System is prohibited and shall be

20

subject to a civil penalty of not more than $5,000.

21

Section 3.  Coordination with other jurisdictions.

22

The Pennsylvania State Police shall coordinate with the

23

authorities of the Federal Government and the various states

24

that are responsible within their respective jurisdictions for

25

the apprehension of those suspected of killing or seriously

26

injuring Federal, State or local law enforcement officers to

27

establish and execute the procedures appropriate to the

28

effective fulfillment of its responsibilities under section 1.

Section 4.  Assessment of cost.

Unless the court finds that undue hardship would result, in

addition to any other cost imposed by law, a cost of $25 shall

2

automatically be assessed on each person convicted, adjudicated

3

delinquent or granted accelerated rehabilitative disposition

4

(ARD) of the offenses named in this section. The cost shall be

5

forwarded to the Commonwealth and used by the Pennsylvania State

6

Police to establish and maintain the Pennsylvania Blue Alert

7

System and apply to the following offenses:

18 Pa.C.S. § 2507 (relating to criminal homicide of law

9

enforcement officer).

10

18 Pa.C.S. § 2702.1 (relating to assault of law

11

enforcement officer).

12

18 Pa.C.S. § 5104 (relating to resisting arrest or other

13

law enforcement).

14

18 Pa.C.S. § 5104.1 (relating to disarming law

15

enforcement officer).

16

18 Pa.C.S. § 5511.2 (relating to police animals).

Section 5.  Immunity.

Owners, licensees, operators and employees of any

19

communication medium, including, but not limited to, telephone,

20

radio, television, newspaper, digital communications network or

21

global communications network, shall be immune from civil

22

liability for their good faith conduct while participating in

23

accordance with this act.

Section 6.  Effective date.

25

This act shall take effect immediately.
