AN ACT
1 Amending Title 34 (Game) of the Pennsylvania Consolidated
2 Statutes, prohibiting the feeding of migratory waterfowl.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Title 34 of the Pennsylvania Consolidated
6 Statutes is amended by adding a section to read:
7 § 2168. Unlawful feeding of migratory waterfowl.
8 (a) General rule.--Except as otherwise provided by law, it
9 is unlawful for a person to feed any migratory waterfowl unless:
10 (1) The feeding is designed to augment the natural
11 source of food available to migratory waterfowl to aid in the
12 prevention of crop damage by the waterfowl.
13 (2) The waterfowl is physically harmed and the feeding
14 is undertaken to treat or heal the waterfowl.
15 (b) Penalty.--A violation of this section is a summary
16 offense of the eighth degree.
17 Section 2. This act shall take effect in 60 days.
