        INTRODUCED BY KAISER, MARKOSEK, TIGUE, SATHER, CAPPELLI,
           READSHAW, HERSHEY, MELIO, WOJNAROSKI, HORSEY, YOUNGBLOOD,
           BELFANTI, WASHINGTON, THOMAS, DIVEN, PALLONE, GRUCELA,
           COLAFELLA AND PISTELLA, MAY 7, 2002

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for school district
     6     participation in economic development organizations.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 610.1.  Participation in Economic Development
    13  Organizations.--Notwithstanding any other provision of law, the
    14  board of school directors of any school district may participate
    15  in an economic development organization by making contributions
    16  or becoming members of the economic development organization if
    17  all of the following criteria are met:
    18     (1)  The proposed development is located entirely or
    19  partially in the school district's boundaries.

     1     (2)  The proposed development is shown to have a future
     2  positive impact on the funding of the school district.
     3     (3)  The economic development organization meets all legal
     4  requirements for nonprofit organizations under Federal or State
     5  law.
     6     (4)  The board of school directors gives public notice of the
     7  proposal and allows at least one meeting for the public to
     8  provide input to the proposal.
     9     Section 2.  This act shall take effect in 60 days.
