                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for false swearing.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 4903(a) of Title 18 of the Pennsylvania
     6  Consolidated Statutes is amended to read:
     7  § 4903.  False swearing.
     8     (a)  False swearing in official matters.--A person who makes
     9  a false statement under oath or equivalent affirmation, or
    10  swears or affirms the truth of such a statement previously made,
    11  when he does not believe the statement to be true is guilty of a
    12  misdemeanor of the second degree if any of the following
    13  paragraphs apply:
    14         (1)  [the] The falsification occurs in an official
    15     proceeding[; or].

     1         (2)  [the] The falsification is intended to mislead a
     2     public servant in performing his official function.
     3         (3)  The falsification is:
     4             (i)  included in:
     5                 (A)  a report under 15 Pa.C.S. § 1554 (relating
     6             to financial reports to shareholders) or 5553
     7             (relating to annual report of directors or other
     8             body); or
     9                 (B)  a document required to be filed with a
    10             Federal or Commonwealth agency; and
    11             (ii)  intended to mislead shareholders or the public
    12         about the true financial condition of the corporation.

    14     Section 2.  This act shall take effect in 60 days.
