                                     AN ACT

     1  Allocating a portion of the revenues from the Oil and Gas Lease
     2     Fund to support a flood control project in Schuylkill County;
     3     and making a repeal.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Allocation of revenue.
     7     The Secretary of Environmental Resources shall allocate from
     8  the Oil and Gas Lease Fund the sum of $2,400,000 for fiscal year
     9  July 1, 1990, to June 30, 1991, for expenditures in support of
    10  the Wabash Creek Flood Control Project in Tamaqua, Schuylkill
    11  County.
    12  Section 2.  Limited repeal.
    13     Section 2 of the act of December 15, 1955 (P.L.865, No.256),
    14  entitled "An act requiring rents and royalties from oil and gas
    15  leases of Commonwealth land to be placed in a special fund to be
    16  used for conservation, recreation, dams, and flood control;
    17  authorizing the Secretary of Forests and Waters to determine the
    18  need for and location of such projects and to acquire the

     1  necessary land," is repealed insofar as it vests discretion in
     2  the Secretary of Environmental Resources to determined
     3  allocations contrary to section 1.
     4  Section 3.  Effective date.
     5     This act shall take effect immediately.
