                                     AN ACT

     1  Amending Title 53 (Municipalities Generally) of the Pennsylvania
     2     Consolidated Statutes, further providing for limitations on
     3     municipal powers.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2962(c)(4) of Title 53 of the
     7  Pennsylvania Consolidated Statutes is amended to read:
     8  § 2962.  Limitation on municipal powers.

    10     (c)  Prohibited powers.--A municipality shall not:
    11         * * *
    12         (4)  Enact or promulgate any ordinance or regulation with
    13     respect to definitions, sanitation, safety, health, standards
    14     of identity or labeling pertaining to the manufacture,
    15     processing, storage, distribution and sale of any [foods,]
    16     goods or services subject to any Commonwealth statutes and
    17     regulations unless the municipal ordinance or regulation is
    18     uniform in all respects with the Commonwealth statutes and

     1     regulations thereunder. This paragraph does not affect the
     2     power of any municipality to enact and enforce ordinances
     3     relating to building codes or any other safety, sanitation or
     4     health regulation pertaining thereto.
