                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for pupil
     6     attendance in certain territory that has been transferred
     7     from one school district to another school district.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 1314 of the act of March 10, 1949
    11  (P.L.30, No.14), known as the Public School Code of 1949, is
    12  amended to read:
    13     Section 1314.  Attendance in District to Which Territory of
    14  Residence Formerly Attached.--(a)  All pupils residing in any
    15  territory belonging to any school district established by the
    16  act, approved the eighteenth day of May, one thousand nine
    17  hundred eleven (Pamphlet Laws 309), which territory at the time
    18  of the approval of said act was attached to another school
    19  district for school purposes, may, if they so desire, attend
    20  during the entire school term of each year the public schools in

     1  the district to which the territory in which they reside was
     2  formerly attached. The district in which they reside shall pay
     3  to the district in which they attend the tuition charge provided
     4  for by this act: Provided, That if the school districts in which
     5  such pupils now reside has or shall hereafter, by the
     6  establishment of new schools or otherwise, provide within
     7  reasonable distance proper school facilities of like grades to
     8  those in the district to which they were formerly attached, then
     9  in any such case, such pupils shall attend the schools in the
    10  district in which they reside. In case of dispute, the decision
    11  of the Superintendent of Public Instruction as to sufficiency
    12  and reasonableness of the school facilities provided by the
    13  school district in which such pupils reside shall be final.
    14     (b)  As of July 1, 2000, pupils residing in any territory
    15  that has been transferred from one school district to another
    16  school district for school purposes may, if they so desire,
    17  continue to attend the public schools in the district to which
    18  the territory in which they reside was formerly attached for the
    19  duration of their attendance in public schools. The district in
    20  which they reside shall pay to the district in which they attend
    21  the tuition charge provided for by this act in accordance with
    22  section 2561.
    23     Section 2.  This act shall take effect immediately.
