                                     AN ACT

     1  Amending the act of May 3, 1933 (P.L.242, No.86), entitled, as
     2     amended, "An act to promote the public health and safety by
     3     providing for examination, licensing and granting of permits
     4     for those who desire to engage in the profession of
     5     cosmetology; defining cosmetology, and regulating cosmetology
     6     shops, schools, students, apprentices, teachers, managers,
     7     manicurists and cosmetologists; conferring powers and duties
     8     upon the Commissioner of Professional and Occupational
     9     Affairs in the Department of State; providing for appeals to
    10     certain courts by applicants and licensees; and providing
    11     penalties," providing for a limited license for hair
    12     colorist.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  Section 1 of the act of May 3, 1933 (P.L.242,
    16  No.86), referred to as the Cosmetology Law, is amended by adding
    17  a definition to read:
    18     Section 1.  Definitions.--The following words and phrases
    19  when used in this act shall have the meanings given to them in
    20  this section unless the context clearly indicates otherwise:

    22     "Hair colorist" means an individual who engages only in the
    23  practice of cleansing, bleaching or coloring of the human hair

     1  or similar work thereon.

     3     Section 2.  Sections 5 and 8 of the act, amended June 30,
     4  1984 (P.L.479, No.100) are amended to read:
     5     Section 5.  Limited Licenses.--A limited license to manicure
     6  the nails only, practice as a hair colorist only and as a
     7  cosmetician only may be applied for and granted under all of the
     8  terms and conditions of this act, except that the examination
     9  therefor may be limited to such practice only and the required
    10  schooling shall be not less than one month. A manicurist may
    11  operate a shop limited to manicuring. A cosmetician may operate
    12  a shop limited to that license. A hair colorist may operate only
    13  in a cosmetology shop. The board may promulgate regulations with
    14  respect to such shops.
    15     Section 8.  Practice in Cosmetology Shops Only.--It shall be
    16  unlawful for any person to practice cosmetology or practice as a
    17  hair colorist for pay in any place other than a licensed
    18  cosmetology shop, manicurist shop or barber shop as defined in
    19  the act of June 19, 1931 (P.L.589, No.202), referred to as the
    20  Barbers' License Law: Provided, That a licensed cosmetologist
    21  may furnish cosmetology treatments to persons in residences of
    22  such persons by appointment.
    23     Section 3.  This act shall take effect in 60 days.
