AN ACT 1 Amending the act of December 16, 1998 (P.L.980, No.129), 2 entitled "An act providing for a waiver of tuition and other 3 fees for children of certain deceased police officers, 4 National Guard members, firefighters and correction employees 5 at community colleges and State-owned and State-related 6 institutions of higher education and for additional powers 7 and duties of the Pennsylvania Higher Education Assistance 8 Agency and the Department of General Services," extending 9 benefits to State or county probation and parole officers. 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. The title of the act of December 16, 1998 13 (P.L.980, No.129), known as the Police Officer, Firefighter, 14 Correction Employee and National Guard Member Child Beneficiary 15 Education Act, is amended to read: 16 AN ACT 17 Providing for a waiver of tuition and other fees for children of 18 certain deceased police officers, National Guard members,
1 firefighters, State or county probation and parole officers 2 and correction employees at community colleges and State- 3 owned and State-related institutions of higher education and 4 for additional powers and duties of the Pennsylvania Higher 5 Education Assistance Agency and the Department of General 6 Services. 7 Section 2. Section 3(a) and (b)(6) of the act, amended 8 November 30, 2004 (P.L.1663, No.210), are amended and 9 subsections (b) and (d) are amended by adding paragraphs to 10 read: 11 Section 3. Postsecondary Educational Gratuity Program. 12 (a) Establishment.--There is hereby established the 13 Postsecondary Educational Gratuity Program for children of 14 police officers, firefighters, correction employees, sheriffs, 15 deputy sheriffs, State or county probation and parole officers 16 and National Guard members and certain other individuals who are 17 on Federal or State active military duty who are residents of 18 this Commonwealth who are killed while acting in the performance 19 of their duties. 20 (b) Eligibility.-- 21 * * * 22 (4.3) A State or county probation and parole officer 23 shall be deemed to have been killed in the performance of his 24 or her duties if death results from job-related injuries 25 sustained or inflicted while maintaining order or security or 26 otherwise carrying out his or her duties as a State or county 27 probation and parole officer. 28 * * * 29 (6) Any child of a police officer, firefighter, 30 correction employee, sheriff, deputy sheriff, State or county 20060H2716B4134 - 2 -
1 probation and parole officer, or National Guard member killed 2 in the performance of his or her duties shall be eligible for 3 an educational gratuity provided the child is 25 years of age 4 or younger at the time of application for participation in 5 this program, meets all admission requirements of the 6 community college or State-owned or State-related institution 7 to which application is made and is enrolled as a full-time 8 student at a community college or a State-owned or State- 9 related institution. 10 * * * 11 (d) Administration.-- 12 * * * 13 (2.2) Written notification of the death of a State 14 probation and parole officer killed in the performance of his 15 or her duties shall be submitted to PHEAA by the Pennsylvania 16 Board of Probation and Parole. 17 (2.3) Written notification of the death of a county 18 probation and parole officer killed in the performance of his 19 or her duties shall be submitted to PHEAA by the president 20 judge, or his designee, who appointed the probation and 21 parole officer. 22 * * * 23 Section 3.
