AN ACT
1 Amending the act of August 15, 1961 (P.L.987, No.442), entitled
2 "An act relating to public works contracts; providing for
3 prevailing wages; imposing duties upon the Secretary of Labor
4 and Industry; providing remedies, penalties and repealing
5 existing laws," requiring contractors and subcontractors to
6 submit employee wage records to the department; providing
7 that records so submitted shall be public records; and
8 extending the time within which actions for wages may be
9 instituted.
10 The General Assembly of the Commonwealth of Pennsylvania
11 hereby enacts as follows:
12 Section 1. Sections 6 and 13 of the act of August 15, 1961
13 (P.L.987, No.442), known as the Pennsylvania Prevailing Wage
14 Act, are amended to read:
15 Section 6. Duty of Contractor.--(a) Every contractor and
16 subcontractor shall keep an accurate record showing the name,
17 craft and the actual hourly rate of wage paid to each workman
18 employed by him in connection with public work, and such record
19 shall be preserved for two years from date of payment. The
20 record shall be open at all reasonable hours to the inspection
1 of the public body awarding the contract and to the secretary. 2 (b) Every contractor or subcontractor shall submit weekly, a 3 copy of all payrolls to the public body awarding the contract. 4 The copy shall include the name and address of the contractor or 5 subcontractor, the payroll number and date of payroll, the 6 project name and location, the project or contract number, the 7 name, address and social security number of all employes, the 8 number of withholding exemptions for each employe, the work 9 classification of all employes, the days, dates and hours of all 10 work performed by each employe, the total hours of work actually 11 worked for that week, the rate of pay for each employe, the 12 gross amount earned by each employe, all deductions from the 13 gross amount earned and the net wages paid to each employe for 14 each week. The record so submitted shall be a public record and 15 subject to the act of act of June 21, 1957 (P.L.390, No.212), 16 referred to as the Right-to-Know Law. 17 Section 13. Workmen's Rights.--Any workmen paid less than 18 the rates specified in the contract shall have a right of action 19 for the difference between the wage so paid and the wages 20 stipulated in the contract, which right of action shall be 21 instituted within [six months] one year from the occurrence of 22 the event creating such right. 23 Section 2.
