AN ACT 1 Amending Title 62 (Procurement) of the Pennsylvania Consolidated 2 Statutes, providing for the purchase of certain energy- 3 efficient products and supplies; and further providing for 4 guaranteed energy service contracts. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Title 62 of the Pennsylvania Consolidated 8 Statutes is amended by adding a section to read: 9 § 313. Purchase of certain products. 10 (a) Energy Star labels.--Notwithstanding any other provision 11 of law and as provided for in section 311 (relating to powers 12 and duties), the department shall, to the extent possible, 13 procure supplies and products for all Commonwealth agencies 14 which have received Energy Star labels as established through 15 the program described in subsection (b). 16 (b) Definition.--As used in this section, the term "Energy 17 Star" means the voluntary labeling program established by the
1 United States Environmental Protection Agency designed to 2 identify and promote energy-efficient products, in order to 3 reduce carbon dioxide emissions. 4 Section 2. Section 3753 of Title 62 is amended by adding a 5 subsection to read: 6 § 3753. Contracting procedures. 7 * * * 8 (a.1) Analysis.--Not later than June 30, 2003, all 9 Commonwealth agencies shall complete a cost-benefit analysis of 10 entering into guaranteed energy savings contracts for all 11 existing buildings. If the analysis demonstrates that there are 12 savings, then all Commonwealth agencies shall enter into 13 guaranteed energy savings contracts for those existing buildings 14 where such savings may occur in accordance with the provisions 15 of this section. 16 * * * 17 Section 3.
