        INTRODUCED BY FREEMAN, BARD, TULLI, GODSHALL, CREIGHTON,
           CAPPELLI, DALEY, HENNESSEY, HORSEY, LEVDANSKY, MANN, MUNDY,
           RUBLEY, STEELMAN, E. Z. TAYLOR, THOMAS, TIGUE, M. WRIGHT AND
           YOUNGBLOOD, OCTOBER 24, 2002

                                     AN ACT

     1  Providing for the allocation of funds received through the State
     2     Energy Program for Clean Cities initiatives.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Clean Cities
     7  Program Assistance Act.
     8  Section 2.  Declaration of policy.
     9     The General Assembly finds and declares as follows:
    10         (1)  The United States Department of Energy's Clean
    11     Cities Program provides support for public-private
    12     partnerships that deploy alternative fuel vehicles and build
    13     supporting alternative fuel infrastructure.
    14         (2)  The Clean Cities Program employs a voluntary
    15     approach to the development of the alternative fuel vehicle
    16     industry by working with coalitions of local stakeholders to


     1     establish local initiatives intended to promote the use of
     2     alternative fuel vehicles.
     3         (3)  Extensive research has demonstrated that the use of
     4     alternative fuel vehicles reduces dependence on petroleum,
     5     most notably, foreign petroleum and also reduces the emission
     6     of pollutants into the air.
     7         (4)  The states of Michigan, New York and New Jersey have
     8     provided state support for the Clean Cities Program through
     9     their State Energy Program funding.
    10         (5)  The Task Force on 21st Century Energy Policy for
    11     Pennsylvania has recommended that the Commonwealth
    12     participate in the Clean Cities Program.
    13         (6)  The Commonwealth receives formula grants through the
    14     United States Department of Energy's State Energy Program.
    15     Each state decides how to use its grant based on its own
    16     identified needs and in accordance with its state energy
    17     plan.
    18         (7)  Clean Cities initiatives in Philadelphia and
    19     Pittsburgh are working to promote the use of alternative fuel
    20     vehicles in those cities. Additional funding support will
    21     enable these efforts to continue and expand.
    22  Section 3.  Definitions.
    23     The following words and phrases when used in this act shall
    24  have the meanings given to them in this section unless the
    25  context clearly indicates otherwise:
    26     "Clean Cities."  The Clean Cities Program of the United
    27  States Department of Energy.
    28     "Department."  The Department of Environmental Protection of
    29  the Commonwealth.
    30     "Program."  The State Energy Program of the United States

     1  Department of Energy.
     2  Section 4.  Allocation of program funds to Clean Cities
     3                 initiatives.
     4     The department shall allocate not less than $50,000 annually
     5  from funds received through the State Energy Program to existing
     6  Clean Cities initiatives in this Commonwealth. To the extent
     7  possible, the funds shall be divided equally among all existing
     8  Clean Cities initiatives.
     9  Section 5.  Effective date.
    10     This act shall take effect in 60 days.
