                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, extending additional parking regulations to ex-
     3     prisoners of war.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3354(d) and (e) of Title 75 of the
     7  Pennsylvania Consolidated Statutes are amended to read:
     8  § 3354.  Additional parking regulations.
     9     * * *
    10     (d)  Handicapped persons, ex-prisoners of war and disabled
    11  veterans.--
    12         (1)  When a motor vehicle bearing a handicapped, ex-
    13     prisoner of war or severely disabled veteran plate or
    14     displaying a handicapped or severely disabled veteran parking
    15     placard as prescribed in this title is being operated by or
    16     for the transportation of the handicapped person, ex-prisoner
    17     of war or severely disabled veteran, the driver shall be

     1     relieved of any liability for parking for a period of 60
     2     minutes in excess of the legal parking period permitted by
     3     local authorities except where local ordinances or police
     4     regulations provide for the accommodation of heavy traffic
     5     during morning, afternoon or evening hours.
     6         (2)  At the request of any handicapped person, ex-
     7     prisoner of war or severely disabled veteran, local
     8     authorities may erect on the highway as close as possible to
     9     their place of residence a sign or signs indicating that that
    10     place is reserved for the handicapped person, ex-prisoner of
    11     war or severely disabled veteran, that no parking is allowed
    12     there by others, and that any unauthorized person parking
    13     there shall be subject to a fine.
    14         (3)  (i)  Except for persons parking vehicles lawfully
    15         bearing a handicapped, ex-prisoner of war or severely
    16         disabled veteran registration plate or displaying a
    17         handicapped or severely disabled veteran parking placard
    18         when such vehicles are being operated by or for the
    19         transportation of a handicapped person, ex-prisoner of
    20         war or a severely disabled veteran, no person shall park
    21         a vehicle on public or private property reserved for a
    22         handicapped person, ex-prisoner of war or severely
    23         disabled veteran which property has been so posted in
    24         accordance with departmental regulations which shall
    25         require a sign stating the penalty amount indicated in
    26         subsection (f), a sign indicating that vehicles in
    27         violation of the subsection may be towed and require that
    28         signs be replaced when they become either obsolete or
    29         missing with all costs to replace the necessary signs to
    30         be borne by the persons responsible for signing the

     1         particular location. Any vehicle which is unlawfully
     2         parked in a designated handicapped parking area may be
     3         removed from that area by towing and may be reclaimed by
     4         the vehicle owner upon payment of the towing costs.
     5             (ii)  Local authorities shall have the power and may,
     6         by ordinance or resolution, authorize handicapped
     7         persons, ex-prisoners of war and severely disabled
     8         veterans to issue statements to violators or violating
     9         vehicles for violation of subparagraph (i). The form of
    10         the statement shall be as prescribed by the local
    11         authorities.
    12     (e)  Unauthorized use.--An operator of a vehicle bearing a
    13  handicapped, ex-prisoner of war or severely disabled veteran
    14  plate or displaying a handicapped or severely disabled veteran
    15  parking placard shall not make use of the parking privileges
    16  accorded to handicapped persons, ex-prisoners of war and
    17  severely disabled veterans under subsection (d)(3) unless the
    18  operator is handicapped, an ex-prisoner of war or a severely
    19  disabled veteran or unless the vehicle is being operated for the
    20  transportation of a handicapped person, ex-prisoner of war or
    21  severely disabled veteran.

    23     Section 2.  This act shall take effect in 60 days.
