                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for immunity
     3     for persons transporting senior citizens.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8332.4(b) of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 8332.4.  Volunteer-in-public-service negligence standard.
     9     * * *
    10     (b)  Exceptions.--
    11         (1)  Nothing in this section shall be construed as
    12     affecting or modifying the liability of such person for acts
    13     or omissions relating to the transportation of participants
    14     in a public service program or project or others to or from a
    15     public service program or project. The provisions of this

     1     paragraph shall not be applicable to volunteers who transport
     2     senior citizen participants in public service programs or
     3     projects.
     4         (2)  Nothing in this section shall be construed as
     5     affecting or modifying any existing legal basis for
     6     determining the liability, or any defense thereto, of any
     7     person not covered by the standard of negligence established
     8     by this section.

    10     Section 2.  This act shall take effect in 60 days.
