           McCALL, REICHLEY, SCAVELLO, SOLOBAY, TANGRETTI, THOMAS,
           TIGUE, TRAVAGLIO, WASHINGTON, YUDICHAK, SCHRODER, DeWEESE,
           KIRKLAND AND GERGELY, JULY 1, 2004

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for teacher qualification.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
     9  as the Public School Code of 1949, is amended by adding a
    10  section to read:
    11     Section 1109.3.  Teacher Qualification by Land Grant
    12  Institution.--(a)  Notwithstanding any other law, the department
    13  shall contract with a land grant institution to do the
    14  following:
    15     (1)  Develop and administer the test required for a teacher
    16  to be certified as a qualified teacher as required by the No
    17  Child Left Behind Act of 2001.


     1     (2)  Develop and administer an alternative method for a
     2  teacher, who does not pass the test set forth in paragraph (1),
     3  to become certified as a qualified teacher as required by the No
     4  Child Left Behind Act of 2001.
     5     (b)  As used in this section, the following words and phrases
     6  shall have the meanings given to them in this subsection:
     7     "Department."  The Department of Education of the
     8  Commonwealth.
     9     "Land grant institution."  An educational institution located
    10  within the geographic boundaries of this Commonwealth that has
    11  received a grant of public land made by the Congress of the
    12  United States for the support of education pursuant to the act
    13  of July 2, 1862 (12 Stat. 503, 7 U.S.C. § 301 et seq.), referred
    14  to as the Morrill Act.
    15     Section 2.  This act shall take effect in 60 days.
