AN ACT
1 Amending Title 23 (Domestic Relations) of the Pennsylvania
2 Consolidated Statutes, providing for custody and visitation
3 petitions by fathers.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 23 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 5315. Petition for partial custody and visitation by father
9 not married to mother.
10 A father who is not married to the mother of his child has
11 standing to petition for partial custody or visitation of the
12 child if all of the following apply:
13 (1) He was not married to the mother of the child at the
14 time of the child's birth.
15 (2) The mother was married to another individual at the
16 time of the child's birth.
17 (3) The mother, by statements or actions, has considered
18 him to be the father of the child.
1 (4) He has provided the mother with financial support
2 for the child on a regular basis.
3 (5) He has visited the child regularly with the consent
4 of the mother.
5 Section 2. This act shall take effect in 60 days.
