                                     AN ACT

     1  Authorizing the incurring of indebtedness, with the approval of
     2     the electors, of $150,000,000 to provide additional funding
     3     for the preservation of land for open-space uses and for the
     4     mitigation of flood hazards.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Referendum.
     8     The question of incurring indebtedness of $150,000,000 to
     9  provide low-interest loans to individuals and businesses
    10  affected by flooding, grants to municipalities for small
    11  disaster preservation and recovery measures and additional
    12  funding for the preservation of land for open-space uses and for
    13  the mitigation of flood hazards shall be submitted to electors
    14  at the next primary, municipal or general election following the
    15  effective date of this act.
    16  Section 2.  Certification.
    17     The Secretary of the Commonwealth shall forthwith certify the

     1  question to the county boards of election.
     2  Section 3.  Form of question.
     3     The question shall be in substantially the following form:
     4         Do you favor the incurring of the indebtedness by the
     5         Commonwealth of $150,000,000 to provide funding for low-
     6         interest loans to individuals and businesses affected by
     7         flooding, grants to municipalities for small disaster
     8         prevention and recovery measures and the preservation of
     9         land for open-space uses and for the mitigation of flood
    10         hazards?
    11  Section 4.  Conduct of referendum.
    12     The election shall be conducted in accordance with the act of
    13  June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania
    14  Election Code, except that the time limits for advertisement of
    15  notice of the election may be waived as to the question.
    16  Section 5.  Use of bond proceeds.
    17     Proceeds of borrowing shall be used to provide funding to
    18  preservation of land for open-space uses and for the mitigation
    19  of flood hazards to promote the purposes of the act of January
    20  19, 1968 (1967 P.L.922, No.442), entitled, as amended, "An act
    21  authorizing the Commonwealth of Pennsylvania and the local
    22  government units thereof to preserve, acquire or hold land for
    23  open space uses" and the act of        ,      (P.L.    , No.
    24  ), known as the Flood Hazard Mitigation Act and the act of
    25          ,       (P.L.    , No.    ), entitled "An act providing
    26  for small disaster assistance, for low-interest loans to
    27  individual disaster victims and businesses and for municipal
    28  grants."
    29  Section 6.  Effective date.
    30     This act shall take effect immediately.
