        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           JUNE 28, 2006

                                     AN ACT

     1  Authorizing the incurring of indebtedness, with the approval of
     2     the electors, of $150,000,000 to provide additional funding
     3     for the preservation of land for open-space uses and for the
     4     mitigation of flood hazards.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Referendum.
     8     The question of incurring indebtedness of $150,000,000 to
     9  provide low-interest loans to individuals and businesses          <--
    10  affected by flooding, grants to municipalities for small
    11  disaster preservation and recovery measures and additional
    12  funding for the preservation of land for open-space uses and for
    13  the mitigation of flood hazards shall be submitted to electors
    14  at the next primary, municipal or general election following the
    15  effective date of this act.
    16  Section 2.  Certification.


     1     The Secretary of the Commonwealth shall forthwith certify the
     2  question to the county boards of election.
     3  Section 3.  Form of question.
     4     The question shall be in substantially the following form:
     5         Do you favor the incurring of the indebtedness by the
     6         Commonwealth of $150,000,000 to provide funding for low-   <--
     7         interest loans to individuals and businesses affected by
     8         flooding, grants to municipalities for small disaster
     9         prevention and recovery measures and the preservation of
    10         land for open-space uses and for the mitigation of flood
    11         hazards?
    12  Section 4.  Conduct of referendum.
    13     The election shall be conducted in accordance with the act of
    14  June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania
    15  Election Code, except that the time limits for advertisement of
    16  notice of the election may be waived as to the question.
    17  Section 5.  Use of bond proceeds.
    18     Proceeds of borrowing shall be used to provide funding to
    19  preservation of land for open-space uses and for the mitigation
    20  of flood hazards to promote the purposes of the act of January
    21  19, 1968 (1967 P.L.922, No.442), entitled, as amended, "An act
    22  authorizing the Commonwealth of Pennsylvania and the local
    23  government units thereof to preserve, acquire or hold land for
    24  open space uses" and the act of        ,      (P.L.    , No.
    25  ), known as the Flood Hazard Mitigation Act. and the act of       <--
    26          ,       (P.L.    , No.    ), entitled "An act providing
    27  for small disaster assistance, for low-interest loans to
    28  individual disaster victims and businesses and for municipal
    29  grants."
    30  Section 6.  Effective date.
