                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for issuance and content of
     3     drivers' licenses.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1510(a) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended and the section is amended by
     8  adding a subsection to read:
     9  § 1510.  Issuance and content of driver's license.
    10     (a)  General rule.--The department shall, upon payment of the
    11  required fee and verification of all facts relative to the
    12  applicant's right to receive a license, including the age,
    13  identity and residence of the applicant, issue to every
    14  qualified applicant a driver's license indicating the type or
    15  general class of vehicles the licensee is authorized to drive
    16  and any endorsements or restrictions, which license shall
    17  contain a distinguishing number assigned by the department to

     1  the licensee, the actual name, date of birth, residence address,
     2  a color photograph or photographic facsimile of the licensee,
     3  one or more security features that are not visible and are
     4  capable of authenticating the license and the information
     5  contained in the license, such other information as may be
     6  required by the department, and either a facsimile of the
     7  signature of the licensee or a space upon which the licensee
     8  shall write his usual signature with pen and ink. Personal
     9  medical data and other information for use in an emergency may
    10  be included as a part of the license. Information other than
    11  that required to identify the licensee, the distinguishing
    12  number and the class of license issued may be included in
    13  microdata form. Except as provided in subsection (f), an
    14  applicant shall include his Social Security number on his
    15  license application, but the Social Security number shall not be
    16  included on the license. No driver's license shall be valid
    17  until it has been signed by the licensee.
    18     (a.1)  Verification.--
    19         (1)  Verification shall include a comparison of existing
    20     driver's license and identification card images in department
    21     files with the applicant's images to ensure that the
    22     applicant has only one identity.
    23         (2)  By July 1, 2003, verification shall utilize
    24     appropriate and accurate technology and techniques.
    25         (3)  The department shall promulgate rules that prohibit
    26     the access and use of images and image comparison technology,
    27     unless the images and image comparison technology are used to
    28     aid the department to ascertain a person's correct identity
    29     or to prevent the issuance of multiple driver's licenses or
    30     identification cards to the same person.

     2     Section 2.  Section 1610 is amended by adding a subsection to
     3  read:
     4  § 1610.  Commercial driver's license.

     6     (a.1)  Verification.--All facts relative to the applicant's
     7  right to receive a commercial driver's license, including the
     8  age, identity and residence of the applicant, shall be verified
     9  in the manner prescribed in section 1510(a.1) (relating to
    10  issuance and content of driver's license).

    12     Section 3.  This act shall take effect in 60 days.
