                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, defining the offense of theft from a
     3     motor vehicle; and providing penalties.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 3934.  Theft from a motor vehicle.
     9     (a)  Offense defined.--A person commits the offense of theft
    10  from a motor vehicle if he unlawfully takes possession of,
    11  carries away or exercises unlawful control over any movable
    12  property of another from a motor vehicle with the intent to
    13  deprive him thereof.
    14     (b)  Grading.--
    15         (1)  An offense under this section is:
    16             (i)  a misdemeanor of the third degree, if the amount
    17         involved was less than $50; or


     1             (ii)  a misdemeanor of the second degree, if the
     2         amount involved was $50 or more but less than $200; or
     3             (iii)  a misdemeanor of the first degree, if the
     4         amount involved was greater than $200.
     5         (2)  When the offense is a third or subsequent offense
     6     within a five-year period, regardless of the amount involved
     7     and regardless of the grading of the prior offenses, an
     8     offense under this section is a misdemeanor of the first
     9     degree.
    10     Section 2.  This act shall take effect in 60 days.
