AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, prohibiting the improper use of
3 municipal recycling containers.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 18 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 6713. Improper use of municipal recycling containers.
9 (a) Offense defined.--A person commits a summary offense if
10 he uses a recycling container owned by a municipality or a party
11 under contract with a municipality, which container is clearly
12 marked as to ownership and supplied to him for the deposit of
13 materials to be collected, for any purpose other than that for
14 which it was supplied.
15 (b) Improper deposit or sorting of materials.--The improper
16 deposit or sorting of materials for collection shall not
17 constitute an offense under this section.
18 (c) Penalty.--A person committing an offense under this
1 section shall be sentenced to pay a fine not to exceed $300.
2 Section 2. This act shall take effect in 60 days.
