AN ACT 1 Amending the act of August 7, 1963 (P.L.549, No.290), entitled, 2 as amended, "An act creating the Pennsylvania Higher 3 Education Assistance Agency; defining its powers and duties; 4 conferring powers and imposing duties on the Governor, 5 President Pro Tempore of the Senate, Speaker of the House of 6 Representatives, Superintendent of Public Instruction and the 7 Department of Auditor General; and making appropriations," 8 providing for an antidrug abuse certification for students. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. The act of August 7, 1963 (P.L.549, No.290), 12 referred to as the Pennsylvania Higher Education Assistance 13 Agency Act, is amended by adding a section to read: 14 Section 4.4. Antidrug Abuse Certification.--(a) The agency 15 shall deny all forms of financial assistance to any resident of 16 this Commonwealth: 17 (1) Who has been convicted in any court of record of 18 violating any Federal or State antidrug laws, including, but not 19 limited to, the Anti-Drug Abuse Act of 1988 (Public Law 100-690,
1 21 U.S.C. § 1501 et seq.) or the act of April 14, 1972 (P.L.233, 2 No.64), known as "The Controlled Substance, Drug, Device and 3 Cosmetic Act"; or 4 (2) Who fails to sign the following antidrug abuse 5 certification which shall be attached to any request for student 6 grants or loans given by the agency: 7 I, ........., certify that, as a condition of my grant or 8 loan, I will not engage in the unlawful manufacture, 9 distribution, dispensation, possession or use of a 10 controlled substance during the period covered by my 11 grant or loan. 12 ..................... 13 Signature 14 (b) Any resident of this Commonwealth who is denied 15 financial assistance under subsection (a) of this section shall 16 be eligible to reapply to the agency for financial aid after one 17 year. 18 (c) The agency shall promulgate rules or regulations 19 necessary to carry out the provisions of this section. The 20 agency shall also create criteria for the acceptance of students 21 that have been denied assistance under this section including 22 requiring the student to remain drug free and to follow all of 23 the prescriptions mandated by the courts. 24 Section 2.
