        REFERRED TO COMMITTEE ON JUDICIARY, SEPTEMBER 25, 2006

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for Pennsylvania
     3     State Police.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6111.1(k) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended and the section is amended by
     8  adding a subsection to read:
     9  § 6111.1.  Pennsylvania State Police.
    10     * * *
    11     (j.4)  Illegal transfers.--The Pennsylvania State Police, in
    12  order to investigate and initiate proceedings for any firearm
    13  offense, shall be authorized to compile, analyze and use
    14  information from all of the following sources:
    15         (1)  An application/record of sale or information
    16     retained from an application/record of sale sent to the
    17     Pennsylvania State Police pursuant to section 6111(b)(1).

     1         (2)  An application/record of sale or information
     2     retained from an application/record of sale sent to the
     3     Pennsylvania State Police pursuant to section
     4     6111(b)(1.1)(i); however, nothing in this paragraph shall
     5     authorize the retention of information in violation of
     6     section 6111(b)(1.1)(v).
     7         (3)  A report of multiple sales or dispositions received
     8     pursuant to 18 U.S.C. § 923(g)(3) (relating to licensing);
     9     however, nothing in this paragraph shall authorize the
    10     retention of information in violation of 18 U.S.C. §
    11     923(g)(3)(B).
    12     (k)  Definitions.--As used in this section, the following
    13  words and phrases shall have the meanings given to them in this
    14  subsection:
    15     "Firearm."  The term shall have the same meaning as in
    16  section 6111.2 (relating to firearm sales surcharge).
    17     "Firearm offense."  An offense under any of the following
    18  provisions of this title (relating to crimes and offenses):
    19         (1)  Chapter 39 (relating to theft and related offenses)
    20     if the property stolen is a firearm.
    21         (2)  Section 6105 (relating to persons not to possess,
    22     use, manufacture, control, sell or transfer firearms).
    23         (3)  Section 6111 (relating to sale or transfer of
    24     firearms).
    25     "Physician."  Any licensed psychiatrist or clinical
    26  psychologist as defined in the act of July 9, 1976 (P.L.817,
    27  No.143), known as the Mental Health Procedures Act.
    28     Section 2.  This act shall take effect in 60 days.
