AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for period of revocation or 3 suspension of operating privilege. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 1541(a) of Title 75 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 1541. Period of revocation or suspension of operating 9 privilege. 10 (a) Commencement of period.-- 11 (1) The period of disqualification, revocation or 12 suspension of the operating privilege or the disqualification 13 of the commercial operating privilege shall commence as 14 provided for in section 1540 (relating to surrender of 15 license). 16 (2) No credit toward the revocation, suspension or 17 disqualification shall be earned until the driver's license
1 is surrendered to the department, the court or the district 2 attorney, as the case may be. A nonresident licensed driver 3 or an unlicensed driver, including a driver whose license has 4 expired, shall submit an acknowledgment of suspension or 5 revocation to the department in lieu of a driver's license, 6 except for the suspension of the operating privilege of an 7 unlicensed driver under 16 years of age, in which case the 8 suspension shall commence automatically upon the individual's 9 16th birthday for the specified period if an acknowledgment 10 is received any time prior to the individual's 16th birthday. 11 If a licensed driver is not in possession of his driver's 12 license, no credit toward the disqualification, revocation or 13 suspension shall be earned until a sworn affidavit or a form 14 prescribed by the department is surrendered to the department 15 swearing that the driver is not in possession of his driver's 16 license. Such credit shall be rescinded if it is later 17 determined that the driver was untruthful in the affidavit. 18 (3) Credit shall also be revoked if a person surrenders 19 a duplicate license and it is later determined that the 20 person was still in possession of an earlier issued, 21 unexpired license. 22 (4) Credit shall also be revoked for any time period in 23 which the person whose license is suspended, revoked or 24 disqualified is incarcerated for a violation of this title. 25 (5) The department may, upon request of the person whose 26 license is suspended or disqualified, delay the commencement 27 of the period of suspension or disqualification for a period 28 not exceeding six months whenever the department determines 29 that failure to grant the extension will result in hardship 30 to the person whose license has been suspended or 19980H2925B4071 - 2 -
