AN ACT 1 Amending Title 35 (Health and Safety) of the Pennsylvania 2 Consolidated Statutes, further providing for emergency 3 management services definitions and for radiological 4 emergencies. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 7102 of Title 35 of the Pennsylvania 8 Consolidated Statutes is amended by adding definitions to read: 9 § 7102. Definitions. 10 The following words and phrases when used in this part shall 11 have, unless the context clearly indicates otherwise, the 12 meanings given to them in this section: 13 * * * 14 "Ingestion exposure pathway." An emergency planning zone 15 which consists of an area with a radius of at least 75 miles. 16 * * * 17 "Plume exposure pathway." An emergency planning zone for
1 nuclear generating facilities which consists of an area with a 2 radius of at least 50 miles. 3 * * * 4 "Radiological emergency planning zone." A zone which 5 includes, at a minimum: 6 (1) an ingestion exposure pathway; and 7 (2) a plume exposure pathway. 8 * * * 9 Section 2. Section 7320(a) of Title 35 is amended, 10 subsection (b) is amended by adding a paragraph and the section 11 is amended by adding a subsection to read: 12 § 7320. Radiological emergency response preparedness, planning 13 and recovery program. 14 (a) Establishment of program.--In addition to the powers and 15 duties of the agency set forth in section 7313 (relating to 16 powers and duties), the agency shall develop, establish and 17 maintain a radiological emergency response preparedness, 18 planning and recovery program for a radiological emergency 19 planning zone which is, at a minimum, consistent with the 20 Commonwealth's Emergency Management Plan and in accordance with 21 other applicable Federal regulations and State laws for each 22 nuclear generating facility that has received an operating 23 license from the Nuclear Regulatory Commission. The exact size 24 and configuration of a radiological emergency planning zone 25 surrounding a particular nuclear power reactor shall be 26 determined in relation to local emergency response needs and 27 capabilities as they are affected by conditions such as 28 demography, topography, land characteristics, access routes and 29 jurisdictional boundaries. Notwithstanding any definitional 30 differences in Federal statutes or regulations, all applicable 20020H2947B4535 - 2 -
1 requirements of Federal statutes and regulations regarding 2 preparedness, planning and recovery shall be applicable to 3 ingestion exposure pathways and plume exposure pathways. 4 (b) Agency functions.--The specific functions of the agency 5 under the radiological emergency response preparedness, planning 6 and recovery program shall include, but not be limited to: 7 * * * 8 (19) Providing a website which contains emergency 9 preparedness, planning and recovery information. 10 * * * 11 (e) Potassium iodide stockpiles.--The agency, in conjunction 12 with the Department of Health, shall insure that sufficient 13 stockpiles of potassium iodide tablets are established at public 14 facilities within at least a 50-mile radius of each nuclear 15 generating facility. Within 180 days of the effective date of 16 this subsection, the agency shall either distribute or have 17 developed a plan for the prompt distribution of the stockpiles 18 to all individuals located within at least a 50-mile radius of 19 each nuclear generating facility in the event of a release of 20 radionuclides. 21 Section 3.
