AN ACT
1 Amending Title 51 (Military Affairs) of the Pennsylvania
2 Consolidated Statutes, providing for equipment and arms.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Title 51 of the Pennsylvania Consolidated
6 Statutes is amended by adding a section to read:
7 § 513. Equipment and arms.
8 (a) General rule.--Any member of the Pennsylvania National
9 Guard or Pennsylvania Guard shall under the following
10 circumstances be properly equipped and armed:
11 (1) Ordered to active State duty for any emergency under
12 section 508 (relating to active State duty for emergency).
13 (2) Ordered to special duty under this title.
14 (3) Voluntarily on active duty or special duty in order
15 to protect and defend this Commonwealth or any facility
16 located in this Commonwealth from terrorist attack or the
1 threat of terrorist attack.
2 (b) Definition.--As used in this section, the term "properly
3 equipped and armed" shall include, but not be limited to, the
4 preplacement of ammunition in their weapons.
5 Section 2. This act shall take effect in 60 days.
