                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for medical benefits.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 1712(1) of Title 75 of the Pennsylvania
     6  Consolidated Statutes is amended to read:
     7  § 1712.  Availability of benefits.
     8     An insurer issuing or delivering liability insurance policies
     9  covering any motor vehicle of the type required to be registered
    10  under this title, except recreational vehicles not intended for
    11  highway use, motorcycles, motor-driven cycles or motorized
    12  pedalcycles or like type vehicles, registered and operated in
    13  this Commonwealth, shall make available for purchase first party
    14  benefits with respect to injury arising out of the maintenance
    15  or use of a motor vehicle as follows:
    16         (1)  Medical benefit.--Subject to the limitations of

     1     section 1797 (relating to customary charges for treatment),
     2     coverage to provide for reasonable and necessary medical
     3     treatment and rehabilitative services, including, but not
     4     limited to, hospital, dental, surgical, psychiatric,
     5     psychological, osteopathic, ambulance, chiropractic, licensed
     6     physical therapy, nursing services, vocational rehabilitation
     7     and occupational therapy, speech pathology and audiology,
     8     optometric services, medications, medical supplies and
     9     prosthetic devices, all without limitation as to time,
    10     provided that, within 18 months from the date of the accident
    11     causing injury, it is ascertainable with reasonable medical
    12     probability that further expenses may be incurred as a result
    13     of the injury. Benefits under this paragraph may include any
    14     nonmedical remedial care and treatment rendered in accordance
    15     with a recognized religious method of healing. A dentist may
    16     request a preauthorization for a service other than acute
    17     care, as defined in section 1797(a). The preauthorization
    18     from the insurer is to determine the eligibility of a
    19     proposed treatment with respect to an injury arising out of
    20     the maintenance or use of a motor vehicle and to determine
    21     the charge allowed by the insurer for that treatment.

    23     Section 2.  This act shall take effect in 60 days.
