AN ACT 1 Amending Title 51 (Military Affairs) of the Pennsylvania 2 Consolidated Statutes, further providing for termination of 3 leases. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 7315(b) of Title 51 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 7315. Termination of leases and similar obligations by 9 military personnel. 10 * * * 11 (b) Leases which may be terminated.--A member of the 12 Pennsylvania National Guard or other reserve component of the 13 armed forces of the United States, as described in subsection 14 (a), or member of any branch of active military service who is 15 being transferred because of an emergency or his agent or
1 attorney-in-fact may terminate or cancel without cost, payment 2 or penalty any lease for premises occupied or used by the member 3 for dwelling, professional, business or agricultural purposes 4 and any lease for an automobile, other motor vehicle, boat, 5 aircraft, furniture, appliances, fixtures or other tangible 6 personal property used by the member for personal, business, 7 agricultural or other private use, provided the lease was 8 executed by or on behalf of the member prior to the commencement 9 of the period of active duty or State active duty or prior to 10 the emergency which results in the transfer and provided the 11 lease was not intended as security under the definition of 12 "security interest" in 13 Pa.C.S. § 1201 (relating to general 13 definitions). 14 * * * 15 Section 2.
