                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     sentence of total confinement.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 9756 of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 9756.  Sentence of total confinement.
     9     * * *
    10     (e)  Disposition of earnings of defendant.--If the defendant
    11  obtains any property or income while incarcerated, the
    12  superintendent or another administrative official of the
    13  institution shall collect it or require the defendant to turn it
    14  over in full, when received, shall deposit it in a trust
    15  account, and shall keep a ledger showing the state of the
    16  account. From the property or income there shall be deducted
    17  without priority the following:
    18         (1)  The board and personal expenses of the defendant.

     1         (2)  Installment on fines, if any.
     2         (3)  To the extent directed by the court, support of the
     3     dependents of the defendant.
     4  If sufficient funds after such deductions are available, the
     5  superintendent or other official may with the consent of the
     6  defendant pay in whole or in part any of the debts of the
     7  defendant. Any balance shall be the property of the institution.
     8     Section 2.  This act shall take effect in 60 days.
