AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for controlled substances testing
3 for school bus and school vehicle drivers.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 75 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 1509.1. Controlled substances testing.
9 The department shall establish by regulation a program
10 requiring employers of school bus drivers and school vehicle
11 drivers to conduct preemployment, reasonable suspicion, random
12 and postaccident testing of the school bus drivers or school
13 vehicle drivers it employs for the use of controlled substances
14 in violation of law. Costs and responsibility for testing shall
15 be borne by the employer for which the driver tested operates.
16 Section 2. This act shall take effect in 120 days.
