SENATE RESOLUTION

No. 28 Session of 1997


        INTRODUCED BY HART, EARLL, CORMAN, MOWERY, HELFRICK, O'PAKE,
           WENGER, TOMLINSON, MURPHY, FUMO, ROBBINS, COSTA, THOMPSON,
           SLOCUM AND LEMMOND, MARCH 12, 1997

        REFERRED TO INTERGOVERNMENTAL AFFAIRS, MARCH 12, 1997

                            A CONCURRENT RESOLUTION

     1  Urging Congress to repeal the Federal Unified Gift and Estate
     2     Tax.

     3     WHEREAS, The Federal Unified Gift and Estate Tax generates a
     4  minimal amount of Federal revenue, especially considering the
     5  high cost of collection and compliance, and has been shown to
     6  decrease those Federal revenues from what they might otherwise
     7  have been; and
     8     WHEREAS, This "death tax" has been identified as destructive
     9  to job opportunity and expansion, especially to minority
    10  entrepreneurs and family farmers; and
    11     WHEREAS, This "death tax" causes severe hardship to growing
    12  family businesses and family farming operations, often to the
    13  point of partial or complete forced liquidation, thereby
    14  depriving state and local governments of an important ongoing
    15  source of revenue; and
    16     WHEREAS, Critical state and local leadership assets are
    17  unnecessarily destroyed and forever lost to the future detriment


     1  of the community through relocation or liquidation; and
     2     WHEREAS, Local and state schools, churches and numerous
     3  charitable activities would greatly benefit from the increased
     4  employment and continued family business leadership; therefore
     5  be it
     6     RESOLVED (the House of Representatives concurring), That the
     7  General Assembly of the Commonwealth of Pennsylvania urge the
     8  Congress of the United States to repeal the Federal Unified Gift
     9  and Estate Tax, effective immediately; and be it further
    10     RESOLVED, That copies of this resolution be transmitted to
    11  the President of the United States, the Speaker of the United
    12  States House of Representatives, the President of the United
    13  States Senate, the Secretary of the Treasury of the United
    14  States and to each member of Congress.
