SENATE RESOLUTION

No. 28 Session of 1997


        INTRODUCED BY HART, EARLL, CORMAN, MOWERY, HELFRICK, O'PAKE,
           WENGER, TOMLINSON, MURPHY, FUMO, ROBBINS, COSTA, THOMPSON,
           SLOCUM AND LEMMOND, MARCH 12, 1997

        AS REPORTED FROM COMMITTEE ON INTERGOVERNMENTAL AFFAIRS, HOUSE
           OF REPRESENTATIVES, AS AMENDED, JUNE 3, 1997

                            A CONCURRENT RESOLUTION

     1  Urging Congress to repeal IMMEDIATELY REVIEW the Federal Unified  <--
     2     Gift and Estate Tax AND TO ACT EITHER TO REPEAL THE LAW, OR    <--
     3     TO GIVE SPECIAL EXEMPTIONS TO FAMILY OWNED FARMS AND
     4     BUSINESSES, OR TO RAISE THE UNIFIED CREDIT AGAINST THE GIFT
     5     AND ESTATE TAXES, OR TO DEFER ESTATE TAX PAYMENTS OVER A
     6     PERIOD OF TIME.

     7     WHEREAS, The Federal Unified Gift and Estate Tax generates a
     8  minimal amount of Federal revenue, especially considering the
     9  high cost of collection and compliance, and has been shown to
    10  decrease those Federal revenues from what they might otherwise
    11  have been; and
    12     WHEREAS, This "death tax" has been identified as destructive
    13  to job opportunity and expansion, especially to minority
    14  entrepreneurs and family farmers; and
    15     WHEREAS, This "death tax" causes severe hardship to growing
    16  family businesses and family farming operations, often to the
    17  point of partial or complete forced liquidation, thereby
    18  depriving state and local governments of an important ongoing


     1  source of revenue; and
     2     WHEREAS, Critical state and local leadership assets are
     3  unnecessarily destroyed and forever lost to the future detriment
     4  of the community through relocation or liquidation; and
     5     WHEREAS, Local and state schools, churches and numerous
     6  charitable activities would greatly benefit from the increased
     7  employment and continued family business leadership; therefore
     8  be it
     9     RESOLVED (the House of Representatives concurring), That the
    10  General Assembly of the Commonwealth of Pennsylvania urge the
    11  Congress of the United States to repeal IMMEDIATELY REVIEW the    <--
    12  Federal Unified Gift and Estate Tax, effective immediately; and   <--
    13  be it further AND TO ACT EITHER TO REPEAL THE LAW, OR TO GIVE     <--
    14  SPECIAL EXEMPTIONS TO FAMILY OWNED FARMS AND BUSINESSES, OR TO
    15  RAISE THE UNIFIED CREDIT AGAINST THE GIFT AND ESTATE TAXES, OR
    16  TO DEFER ESTATE TAX PAYMENTS OVER A PERIOD OF TIME; AND BE IT
    17  FURTHER
    18     RESOLVED, That copies of this resolution be transmitted to
    19  the President of the United States, the Speaker of the United
    20  States House of Representatives, the President of the United
    21  States Senate, the Secretary of the Treasury of the United
    22  States and to each member of Congress from Pennsylvania.
