AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," further providing for the definition

6

of "eligible provider" in Pennsylvania Pre-K Counts Program.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  The definition of "eligible provider" in section

10

1511-D of the act of March 10, 1949 (P.L.30, No.14), known as

11

the Public School Code of 1949, amended July 9, 2008 (P.L.846,

12

No.61), is amended to read:

Section 1511-D.  Definitions.

The following words and phrases when used in this subarticle

15

shall have the meanings given to them in this section unless the

16

context clearly indicates otherwise:

"Eligible provider."  Any of the following entities if the

19

entity complies with all quality program standards established

20

by the Department of Education:

(1)  A school district.

2

(2)  A Head Start program.

3

(3)  A nursery school licensed under the act of January

4

28, 1988 (P.L.24, No.11), known as the Private Academic

5

Schools Act.

(4)  One of the following:

7

(i)  Prior to July 1, 2009, a child day care center

8

[or], a group day care home or a registered family day

9

care home that has met or exceeded the standards of STAR

10

2 under the Keystone STARS quality rating system

11

established by the Department of Public Welfare.

12

(ii)  After June 30, 2009, a child day care center

13

[or], a group day care home or a registered family

14

daycare home that has met or exceeded the standards of

15

STAR 3 under the Keystone STARS quality rating system

16

established by the Department of Public Welfare. Any

17

approved provider under this subparagraph which has

18

applied for a STAR 3 rating and which application has not

19

been approved or rejected by the department as of June

20

30, 2009, shall remain eligible for the program until

21

such application is rejected.

Section 2.  This act shall take effect immediately.
