                                     AN ACT

     1  Amending the act of March 2, 1956 (1955 P.L.1211, No.376),
     2     entitled "An act providing for and regulating the licensing
     3     and practice of practical nursing; imposing duties on the
     4     State Board of Nurse Examiners; and imposing penalties,"
     5     further providing for licenses, duration, renewal and
     6     inactive status.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 13.1 of the act of March 2, 1956 (1955
    10  P.L.1211, No.376), known as the Practical Nurse Law, added
    11  December 20, 1985 (P.L.423, No.110), is amended to read:
    12     Section 13.1.  Licenses, Duration, Renewal, Inactive
    13  Status.--(a)  Licenses issued pursuant to this act shall expire
    14  on the thirtieth day of June of each biennium, or on such other
    15  biennial expiration date as may be established by regulation of
    16  the board. Application for renewal of a license shall biennially
    17  be forwarded to each person holding a current license prior to
    18  the expiration date of the current renewal biennium. The
    19  application form shall be completed and returned to the board,


     1  accompanied by the required fee, as determined by the board by
     2  regulation; upon approval of each application, the applicant
     3  shall receive a renewal of license.
     4     (b)  Any person licensed under this act may request an
     5  application for inactive status. The application form may be
     6  completed and returned to the board; upon receipt of each
     7  application, the applicant shall be maintained on inactive
     8  status without fee and shall be entitled to apply for an active
     9  license at any time. Any person who requests an active status
    10  license who has been on inactive status for a period of [five
    11  (5)] two (2) consecutive years shall, prior to receiving an
    12  active license, satisfy the requirements of the board's
    13  regulations for ensuring continued competence, and remit the
    14  required fee. A person shall not be denied active status as a
    15  result of any increased educational requirements for licensure
    16  since the time he or she received his or her original license.
    17     Section 2.  This act shall apply to persons who are on
    18  inactive status and who file an application for active status
    19  under section 13.1(b) of the act after the effective date of
    20  this act.
    21     Section 3.  This act shall take effect in 60 days.
