           ORIE, GREENLEAF, RAFFERTY, STOUT, C. WILLIAMS AND KASUNIC,

        REFERRED TO AGING AND YOUTH, JANUARY 27, 2003

                                     AN ACT

     1  Amending the act of August 26, 1971 (P.L.351, No.91), entitled
     2     "An act providing for a State Lottery and administration
     3     thereof; authorizing the creation of a State Lottery
     4     Commission; prescribing its powers and duties; disposition of
     5     funds; violations and penalties therefor; exemption of prizes
     6     from State and local taxation and making an appropriation,"
     7     further defining "maximum annual income."

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The definition of "maximum annual income" in
    11  section 502 of the act of August 26, 1971 (P.L.351, No.91),
    12  known as the State Lottery Law, added November 21, 1996
    13  (P.L.741, No.134), is amended to read:
    14  Section 502.  Definitions.
    15     The following words and phrases when used in this chapter
    16  shall have the meanings given to them in this section unless the
    17  context clearly indicates otherwise:

    19     "Maximum annual income."  For PACE eligibility, the term


     1  shall mean the following:
     2         (1)  Between November 21, 1996, and December 31, 2002, a
     3     person may not have annual income which [shall not exceed]
     4     exceeds $14,000 in the case of single persons nor $17,200 in
     5     the case of the combined annual income of persons married to
     6     each other.
     7         (2)  Beginning January 1, 2002 and each January 1
     8     thereafter, the maximum annual income for the preceding year
     9     shall be increased by an annual cost-of-living increase
    10     calculated by applying the percentage change in the Consumer
    11     Price Index for All Urban Consumers (CPI-U) for the
    12     Pennsylvania, New Jersey, Delaware and Maryland area, for the
    13     most recent 12-month period for which figures have been
    14     officially reported by the United States Department of Labor,
    15     Bureau of Labor Statistics immediately prior to the date the
    16     adjustment is due to take effect. The percentage increase and
    17     the annual income amounts shall be determined by the
    18     Department of Aging prior to the annual effective date of the
    19     adjustment and shall be published by the Secretary of Aging
    20     in the Pennsylvania Bulletin within 20 days of the date the
    21     determination is made.
    22         (3)  Persons may, in reporting income to the Department
    23     of Aging, round the amount of each source of income and the
    24     income total to the nearest whole dollar, whereby any amount
    25     which is less than 50¢ is eliminated.

    27     Section 2.  If enacted after January 1, 2004, this act shall
    28  be retroactive to January 1, 2004.
    29     Section 3.  This act shall take effect immediately.
