SENATE BILL

No. 77 Session of 2001


        INTRODUCED BY HOLL, JANUARY 23, 2001

        SENATOR GREENLEAF, JUDICIARY, AS AMENDED, MARCH 13, 2001

                                     AN ACT

     1  Amending the act of November 22, 1978 (P.L.1166, No.274),
     2     entitled "An act establishing the Pennsylvania Commission on
     3     Crime and Delinquency, providing for its powers and duties
     4     establishing several advisory committees within the
     5     commission and providing for their powers and duties,"
     6     further providing for the composition and duties of the
     7     Pennsylvania Commission on Crime and Delinquency and the
     8     composition of the Juvenile Advisory Committee.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 2(b) of the act of November 22, 1978
    12  (P.L.1166, No.274), referred to as the Pennsylvania Commission
    13  on Crime and Delinquency Law, amended December 15, 1999
    14  (P.L.922, No.60), is amended to read:
    15  Section 2.  Pennsylvania Commission on Crime and Delinquency.

    17     (b)  Composition.--The commission shall consist of the
    18  following members:
    19         (1)  The Attorney General.
    20         (2)  The Chief Justice of Pennsylvania.


     1         (3)  The Court Administrator of Pennsylvania.
     2         (4)  A judge of a court of common pleas.
     3         (5)  Commissioner of State Police.
     4         (6)  The chairmen of the House and Senate Majority
     5     Appropriations Committees.
     6         (7)  The chairman of the Juvenile Advisory Committee.
     7         (8)  Four members of the General Assembly, of whom one
     8     shall be designated by, and serve at the pleasure of the
     9     President pro tempore of the Senate, one by the Minority
    10     Leader of the Senate, one by the Speaker of the House of
    11     Representatives and one by the Minority Leader of the House
    12     of Representatives.
    13         (9)  Four members appointed by the Governor, one
    14     representative of local law enforcement agencies, one
    15     representative of adult correctional rehabilitative agencies,
    16     one representative of local elected officials and one
    17     district attorney representative.
    18         (10)  Seven private citizens appointed by the Governor,
    19     at least two of which serve on the Juvenile Advisory
    20     Committee.
    21         (11)  Secretary of Corrections.
    22         (11.1)  Secretary of Public Welfare, or his designee.
    23         (11.2)  Secretary of Education, or his designee.
    24         (11.3)  Chairman of the Juvenile Court Judges'
    25     Commission, OR HIS DESIGNEE.                                   <--
    26         (12)  The Victim Advocate.
    27         (13)  Such additional members appointed by the Governor
    28     as are necessary to implement programs authorized by State
    29     and Federal law.

     1     Section 2.  Section 3 of the act is amended by adding a
     2  paragraph to read:
     3  Section 3.  Powers and duties of the commission.
     4     The commission shall have the power and its duty shall be:
     5         * * *
     6         (17)  To serve as the primary State agency for planning,
     7     policy development and coordination of the juvenile justice
     8     system.
     9     Section 3.  The act is amended by adding a section to read:
    10  Section 3.1.  Long-range plan.
    11     (a)  Development of plan.--The commission, with the
    12  assistance of the Juvenile Advisory Committee, shall prepare a
    13  long-range, comprehensive juvenile justice plan based on the
    14  Commonwealth's needs. The plan shall include recommendations for
    15  planning, policy development and coordination for the juvenile
    16  justice system.
    17     (b)  Implementation and monitoring.--Upon the adoption of a
    18  long-range plan, the commission, with the assistance of the
    19  Department of Public Welfare and the Juvenile Court Judges'
    20  Commission, shall develop a strategy for implementing,
    21  monitoring and updating the plan.
    22     (c)  Annual report.--The commission shall annually submit a
    23  report to the General Assembly on the status of the long-range
    24  plan, including recommendations for legislative action necessary
    25  to implement the plan.
    26     Section 4.  Section 6 of the act is amended by adding a
    27  subsection to read:
    28  Section 6.  Juvenile Advisory Committee.

    30     (c.1)  Additional members.--In addition to the appointed

     1  members of the committee, the Deputy Secretary for Children,
     2  Youth and Families within the Department of Public Welfare, or    <--
     3  his designee, OR HIS DESIGNEE, A COUNTY COMMISSIONER and the      <--
     4  Executive Director of the Juvenile Court Judges' Commission
     5  shall serve as members of the committee.

     7     Section 5.  This act shall take effect in 60 days.
