THE GENERAL ASSEMBLY OF PENNSYLVANIA


SENATE BILL

No. 86 Session of 1997

                                     AN ACT

     1  Conferring the powers of police officers on sheriffs and their
     2     deputies in certain instances.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Limited police power of sheriffs.
     6     Sheriffs and their deputies shall possess and may exercise
     7  the powers of police officers of this Commonwealth in the
     8  following locations:
     9         (1)  The immediate and adjacent vicinity of the
    10     courthouse of the county for which they are elected or
    11     appointed.
    12         (2)  The courthouse of the county for which they are
    13     elected or appointed.
    14         (3)  Recreational areas and other facilities owned by the
    15     county for which they are elected or appointed.
    16  Section 2.  Fresh pursuit jurisdiction.
    17     Sheriffs and deputies may arrest an offender beyond the


     1  limits set forth in section 1 if they are in fresh pursuit of an
     2  offender who commits an offense within an area set forth in
     3  section 1.
     4  Section 3.  Detention.
     5     Keepers of jails and other places of detention in a county of
     6  this Commonwealth shall receive and detain all persons arrested
     7  by sheriffs and their deputies.
     8  Section 4.  Effective date.
     9     This act shall take effect in 60 days.
