SENATE RESOLUTION

No. 89 Session of 1999


        INTRODUCED BY BOSCOLA, MELLOW, O'PAKE, COSTA, MUSTO, KUKOVICH,
           WAGNER, KASUNIC, LAVALLE AND KITCHEN, JUNE 14, 1999

        REFERRED TO INTERGOVERNMENTAL AFFAIRS, JUNE 14, 1999

                                  A RESOLUTION

     1  Urging Attorney General Michael Fisher to file a lawsuit on
     2     behalf of the citizens of this Commonwealth against the State
     3     of New York to enjoin its enforcement of the New York City
     4     commuter tax and to seek its repeal.

     5     WHEREAS, New York Governor George Pataki signed legislation
     6  in late May that repealed the 33-year-old commuter tax only for
     7  residents of his state but continued to impose the 0.45% tax on
     8  the income of over 300,000 out-of-state commuters, mainly from
     9  New Jersey, Connecticut and Pennsylvania; and
    10     WHEREAS, It is fundamentally unfair for commuters from
    11  Pennsylvania to have to pay a tax that commuters from New York
    12  do not have to pay; and
    13     WHEREAS, The states of Connecticut and New Jersey have both
    14  filed class action lawsuits against the State of New York
    15  challenging the constitutionality of this preferential repeal;
    16  therefore be it
    17     RESOLVED, That the Senate urge Attorney General Michael
    18  Fisher to file a lawsuit on behalf of the citizens of this
    19  Commonwealth against the State of New York to enjoin its

     1  enforcement of the New York City commuter tax and to seek its
     2  repeal.
