AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," further providing for exceptions to 6 compulsory attendance; and providing for the deletion from 7 school rolls of certain pupils in school districts of the 8 first class. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Section 1330(5) of the act of March 10, 1949 12 (P.L.30, No.14), known as the Public School Code of 1949, 13 amended May 11, 1949 (P.L.1195, No.361), is amended and the 14 section is amended by adding a clause to read: 15 Section 1330. Exceptions to Compulsory Attendance.--The 16 provisions of this act requiring regular attendance shall not 17 apply to any child who-- 18 * * * 19 (5) Except in districts of the fourth class and those of the 20 third class located wholly within the boundary lines of a
1 township, or within the boundary lines of a borough which has a 2 population of less than five hundred (500) inhabitants to the 3 square mile, resides two miles or more by the nearest public 4 highways from any public school in session and no proper free 5 transportation is furnished to such child to and from school[.]; 6 (6) Is a pupil in a school district of the first class who 7 has been deleted from the list of pupils enrolled in the 8 district under section 1330.1. 9 Section 2. The act is amended by adding a section to read: 10 Section 1330.1. Deletion of Certain Pupils in Districts of 11 the First Class.--(a) Notwithstanding any other provision of 12 this act to the contrary, a pupil in a school district of the 13 first class who has attained the age of sixteen (16) years and 14 who has been absent without lawful excuse for twenty (20) or 15 more days during the school year shall be deleted from the list 16 of pupils enrolled in the school district. Thereafter, the 17 compulsory attendance provisions of this article shall not apply 18 to the pupil, the pupil's parents or the school district. 19 (b) (1) The State Board of Education may, upon 20 recommendation of the superintendent of schools, readmit a pupil 21 whose name has been deleted under subsection (a). 22 (2) A pupil whose name has been deleted under subsection (a) 23 shall be eligible for readmission to a school within the 24 district until the pupil has attained the age of twenty-one (21) 25 years, until graduation from another public or private school 26 entity or until acquisition of a General Educational Development 27 (GED) certificate. Upon readmission, the pupil shall be assigned 28 to a specially designated school where athletics and 29 extracurricular activities are not offered. 30 Section 3.
