SENATE BILL

        REFERRED TO ENVIRONMENTAL RESOURCES AND ENERGY,
           JANUARY 23, 1989

                                     AN ACT

     1  Amending the act of May 5, 1927 (P.L.817, No.412), entitled, as
     2     amended, "An act authorizing and regulating the growth, sale,
     3     and distribution of forest tree seedlings, transplants,
     4     shrubs and vines by the Department of Forests and Waters;
     5     regulating the use of such forest tree seedlings,
     6     transplants, shrubs and vines and imposing duties upon the
     7     Department of Agriculture with regard to the enforcement of
     8     this act," removing certain restrictions on the sale of
     9     trees, shrubs or vines.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 3 of the act of May 5, 1927 (P.L.817,
    13  No.412), entitled, as amended, "An act authorizing and
    14  regulating the growth, sale, and distribution of forest tree
    15  seedlings, transplants, shrubs and vines by the Department of
    16  Forests and Waters; regulating the use of such forest tree
    17  seedlings, transplants, shrubs and vines and imposing duties
    18  upon the Department of Agriculture with regard to the
    19  enforcement of this act," amended June 21, 1947 (P.L.777,
    20  No.333), is amended to read:
    21     Section 3.  No trees, shrubs or vines shall be sold by the

     1  department, under the provisions of this act, that are to be
     2  planted for hedges, table trees, or potted trees [or for shade
     3  or ornamental use].
     4     Section 2.  This act shall take effect in 60 days.
