                                     AN ACT

     1  Amending the act of April 29, 1994 (P.L.141, No.22), entitled
     2     "An act providing for the preservation of historic burial
     3     places and tombs, monuments and gravestones; and imposing
     4     penalties," further providing for offenses.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 5(b) of the act of April 29, 1994
     8  (P.L.141, No.22), known as the Historic Burial Places
     9  Preservation Act, is amended to read:
    10  Section 5.  Offenses.

    12     (b)  Unlawful possession of monuments, gravestones, veterans'
    13  markers, or certain other structures.--A person commits a
    14  misdemeanor of the second degree if he possesses or sells,
    15  offers for sale or attempts to sell or transfers or disposes of
    16  any monument, gravestone, veteran's marker or other structure or
    17  any portion or fragment thereof, placed or designed for a
    18  memorial of the dead, [knowing] believing that it has been


     1  [unlawfully] removed from a historic burial place.
     2     Section 2.  This act shall take effect in 60 days.
