1 | Urging the Congress of the United States to pass legislation |
2 | amending the Consumer Product Safety Improvement Act of 2008 |
3 | to exclude youth all-terrain vehicles, motorcycles and |
4 | snowmobiles from the lead-limit requirements of the Consumer |
5 | Product Safety Improvement Act of 2008. |
6 | WHEREAS, A new Federal law, the Consumer Product Safety |
7 | Improvement Act of 2008 (Public Law 110-314, 122 Stat. 3016), |
8 | aimed at protecting children from lead in toys, has also forced |
9 | a nationwide halt in sales of off-road motorcycles and |
10 | recreational vehicles built for young riders, a multimillion- |
11 | dollar industry that was thriving despite the recession; and |
12 | WHEREAS, On February 10, 2009, the Consumer Product Safety |
13 | Improvement Act of 2008 requirements that limit the lead content |
14 | in all products made for children went into effect; and |
15 | WHEREAS, Under the Consumer Product Safety Improvement Act of |
16 | 2008, "children's product" means a consumer product designed or |
17 | intended primarily for children 12 years of age or younger; and |
18 | WHEREAS, Youth-model all-terrain vehicles (ATVs), off-highway |
19 | motorcycles and snowmobiles, as well as the parts and |

1 | accessories for youth ATVs, motorcycles and snowmobiles, are |
2 | severely impacted by the new lead limits established under the |
3 | Consumer Product Safety Improvement Act of 2008; and |
4 | WHEREAS, As a result of the Consumer Product Safety |
5 | Improvement Act of 2008, thousands of powersports dealers were |
6 | told to halt all sales of new and used vehicles designed for |
7 | children 12 years of age and younger; and |
8 | WHEREAS, Consumers have borrowed significant amounts of money |
9 | on untold hundreds of thousands of youth ATVs, motorcycles and |
10 | snowmobiles; and |
11 | WHEREAS, Parts for these youth ATVs, motorcycles and |
12 | snowmobiles are unavailable, which in many cases renders the |
13 | ATVs, motorcycles and snowmobiles inoperable or not safe to |
14 | operate or causes the machines to perform improperly; and |
15 | WHEREAS, Congress needs to adopt a common sense approach to |
16 | the implementation of the lead provisions in the Consumer |
17 | Product Safety Improvement Act of 2008 in order to avoid major |
18 | disruptions to youth ATV, motorcycle and snowmobile enthusiasts, |
19 | owners, manufacturers and the dealer network of thousands of |
20 | small, independent businesses which employ tens of thousands of |
21 | Americans; and |
22 | WHEREAS, While protecting children from those products that |
23 | truly present a lead risk is important, there should be an |
24 | exclusion for products that do not truly present a lead risk to |
25 | children; and |
26 | WHEREAS, While the Consumer Product Safety Improvement Act of |
27 | 2008 provides for exclusions and authorizes the Consumer Product |
28 | Safety Commission to grant exclusions under certain conditions, |
29 | to date, the Consumer Product Safety Commission has not granted |
30 | any exclusions for youth ATVs, motorcycles and snowmobiles; and |

1 | WHEREAS, Although the Consumer Product Safety Commission has |
2 | issued a stay until May 1, 2011, any further delay in providing |
3 | permanent relief for youth ATVs, motorcycles and snowmobiles |
4 | creates an untenable situation for thousands of owners, |
5 | manufacturers and dealers, many of whom are small businesses; |
6 | and |
7 | WHEREAS, Large inventories of products that present no health |
8 | risk to children are rendered retroactively illegal, and future |
9 | products are prohibited from sale; and |
10 | WHEREAS, State Attorneys General have the authority to |
11 | enforce the Consumer Product Safety Improvement Act of 2008 |
12 | regardless of the stay; therefore be it |
13 | RESOLVED, That the Senate of the Commonwealth of Pennsylvania |
14 | urge the Congress of the United States to pass legislation that |
15 | excludes all youth all-terrain vehicles, off-highway motorcycles |
16 | and snowmobiles from the provisions of the Consumer Product |
17 | Safety Improvement Act of 2008; and be it further |
18 | RESOLVED, That a copy of this resolution be transmitted to |
19 | the President of the United States, the presiding members of |
20 | each house of Congress, each member of Congress from |
21 | Pennsylvania and the members of the Consumer Product Safety |
22 | Commission. |
