AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," further providing for 21 disposition of surplus Commonwealth lands acquired by 22 condemnation. 23 The General Assembly of the Commonwealth of Pennsylvania 24 hereby enacts as follows: 25 Section 1. Section 2403-A of the act of April 9, 1929 26 (P.L.177, No.175), known as The Administrative Code of 1929, 27 added July 1, 1981 (P.L.143, No.48), is amended to read:
1 Section 2403-A. Property Disposition Plan.--(a) The 2 department shall annually develop a plan for the orderly 3 disposition of all real property deemed surplus by the agency 4 currently in possession of the property, which property is not 5 suitable for use by another agency. 6 (b) The plan shall consider the following factors in 7 proposing the manner and schedule for property disposition: 8 (1) Whether the property should be leased, transferred in 9 fee simple, or transferred with a restriction as to use, right 10 of reversion, or other special deed provisions. 11 (2) Whether the land should be retained in agricultural use 12 or as open space for recreation or conservation. A determination 13 whether land should be preserved as open space or in 14 agricultural use shall be made in consultation with the 15 Department of Agriculture, the Department of Environmental 16 Resources and the Department of Community Affairs. 17 (3) Likely cost savings and expenses to the Commonwealth 18 arising from the proposed property disposition. 19 (4) The needs of local governments, charitable institutions, 20 and local volunteer fire and rescue squads. 21 (5) The likely revenue to be generated by the sale of the 22 property and the needs of the Commonwealth for those revenues. 23 (c) The plan for the disposition of surplus property shall, 24 for each parcel, identify the proposed manner of disposition, 25 when the property will be disposed of, likely revenues and 26 costs, the assessed market value of the property, and the 27 Commonwealth's acquisition cost for the property. 28 [(d) Any Commonwealth lands acquired by condemnation which 29 is later determined to be surplus land shall be disposed 30 pursuant to and consistent with the provisions of section 19970S0160B0155 - 2 -
